ZO/BTI/2012/NOC/64 dated 10.7.2012 …………. • Thereafter, the PP applied for Consent to operate of the Residential Colony" in an area of about 12.04 acre having total 156 no. Residential Plots & 27 commercial shops, which were refused in view of the Department of Housing and Urban Development notification issued vide no. G.S.R. 144/P.A.11/1995/Ss. 180 and 43/2021 dated 31.08.2021 circulated by the Board vide Head Office letter no. 15864-82 dated 22.07.2022, wherein it has been specified that the population of plotted development shall be counted @ 15 persons per plot, however the project proponent has calculated the wastewater generation as per @ 5 persons/plot, hence the calculation of water pollution load was not adequate. Further, as the terminal STP has not been installed, hence the disposal arrangements provided by the colony were also not adequate............... • Now, application again applied for obtaining CTOs under the Water Act, 1974 and Air Act, 1981 with operation of the 20 no. residential plots (in an area of about 12.04 acre having total 156 no. Residential Plots & 27 commercial shops)………….. • Present occupancy of just one house and 10 houses are under construction…….. Septic tank installed for treatment of the effluent generated and STP of capacity 90KLD installed, but the same has not been commissioned due to inadequate effluent…… The PP has proposed to discharge treated effluent @ 31.36 KLD (considering 15 persons/plot for 20 houses) onto parks @ 0.6 acres and for road side plantation @ 0.34 acres……………. • The PP does not have adequate disposal arrangement for the entire project i.e. for 156 no. Residential Plots & 27 commercial shops for which NOC was obtained by it……. • EE, RO has submitted proposed SCN for refusal of CTOs considering that the promoter is required to obtain the permission (CTE) for regularization for whole colony before obtaining consent to operate for 20 houses. The promoter failed to provide disposal arrangements for whole project. Adequate arrangements are not available and plots can be sold by the promoter, which lead to generation of more effluent than consented capacity. ……….. • In view of above, if approved, SCN be issued for refusal of CTOs under the Water Act, 1974 and Air Act, 1981 alongwith an opportunity of personal hearing before SEE(B)…….
