Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 25.07.2024 w.r.t. show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981 to M/s NDD Developers LLP, Jaspal Bangar Road, Jaspal Bangar, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the project proponent has applied for Consent to Establish (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of new COMMERCIAL COLONY plotting colony in an area 4 Acre.
The application of the industry has been perused and it has been observed as under:-
1. The project proponent has applied for the establishment of new COMMERCIAL COLONY plotting colony in an area 4 Acre and the project proponent has failed to install STP for treatment of effluent generated from the project in compliance of NGT orders for discharge of domestic effluent from the project and Regional Office has not commented on NGT order no. 199 of 2014, 61 of 2017 & 281 of 2016.
2. The project proponent has failed to submit permission from the Municipal Corporation, Ludhiana for discharge of domestic effluent into sewer.
3. The project proponent has failed to attach the copy of detailed Map. However, area mentioned in the application form is 4 Acre.
4. It is a commercial colony plotting colony and failed to attach the approved Map from which it can be observed whether it is covered under the Environment Clearance or not.
5. The project proponent has not submitted the latest approval/approved layout plan from the Competent Authority with clear cut detail of total land area etc. 6. The project proponent has not submitted the detail of Solid waste generation and its disposal arrangements. The colony has not provided Bio composter/composting pits.
The industry is not complying with the provisions of Water Act, 1974 and Air Act, 1981. Thus, violating provisions of said Acts.
The industry was issued show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 11.07.2024. But, no one from the industry attended the above said hearing.
In view of the above, the industry was issued show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 25.07.2024.
No one from industry attended the hearing and not submitted any written reply.
It is further submitted that the industry was given opportunity of personal hearing before the Senior Environmental Engineer of the Board two times i.e. on 11.07.2024 and 25.07.2024, but no one from the industry attended the both opportunities of personal hearing and not submitted any written reply to show cause notice issued to it.
After hearing, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that the 'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be refused.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
