File Note: Recommendations : It is submitted that a complaint from Sh. Balwant Singh, Sh. Davinder Singh, Sh. Hardeep Singh, Sh. Varinder Singh and representative of the Gram Panchayat shergarh khurd & Others residents of Village Shergarh, Tehsil patran, Distt Patiala was received in this office on 13.06.2024 regarding establishment of a new poultry farm unit near the residential houses of the complainants without obtaining any NOC from the Board. To verify the contentions of the complaint, the poultry farm was earlier visited by the Officer of the Board on 25.06.2024. During visit, it was observed as under 1. The establishment is a broiler farm & completed construction of shed capacity of around 6000 chicks. However, no birds were present there. 2. The establishment has not constructed any boundary wall along the shed. 3. The establishment has started construction without obtained Consent to Establish (NOC) from the Board. Accordingly, the poultry farm was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 Board's vide letter no.1621 dated 27.06.2024. However, no written reply regarding the show cause notice was received in this office from the poultry farm. Now, the PP of the poultry farm has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for operation of broiler farm of capacity 9500 birds in the revenue estate of Vill. Shergarh, Tehsil Patran, Distt. Patiala. The poultry farm has deposited Rs. 1400/- vide online receipt no. N199243156108613 dated 17.07.2024 as NOC reregulation fee and has deposited Rs. 1400/- vide online receipt no. N198243154695456 dated 17.07.2024 as water consent fee and Rs. 1400/- vide receipt no. N199243156120851 dated 17.07.2024 as air consent fee against the fixed assets of Rs. 23.61 lakh as on 08.07.2024 as per CA certificate dated 08.07.2024, which is adequate upto 30.06.2025. The poultry farm has obtained land use pattern for the site of poultry farm from Deptt. of Town and Country, Planning vide its memo no. 1228 dated 10.07.2024. As per the classification certificate, the site of the poultry farm is located at khasra no. 17/25 (7-4) and the project proponent has constructed a shed of size 210ft x 50ft. It is further mentioned that the site falls within local planning area of Patran, whose Master Plan is yet to be notified. Therefore, as per the guidelines issued by the Director, Town & Country, Planning, Punjab vide its letter no. 2180-2283/CTP(Pb)/SP-432(Gen) dated 14.06.2023, ਜ਼ੋ ਸਾਈਟਾਂ ਕਿਸੇ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀਆਂ, ਜੇਕਰ ਉਹ ਵਿਭਾਗ ਦੀਆਂ sitting guidelines ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦੀ ਹੈ ਤਾਂ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਸ਼ਰਤ ਲਗਾਉਂਦੇ ਹੋਏ ਐਕਟੀਵਿਟੀ ਨੂੰ ਪ੍ਰਵਾਨਗੀ ਦਿੱਤੀ ਜਾਣੀ ਬਣਦੀ ਹੈ। The copy of DTP letter is attached herewith. Further, the project proponent has also submitted certified issued by Tehsildar Patran regarding verification of various siting parameters for establishment of poultry farm as per latest guidelines issued by CPCB vide its letter dated 10.01.2022 in light of the NGT order dated 10.12.2021 in O.A. No. 320/2021 Sr. No . Criteria For New Poultry Farm as per notification CPCB letter no. CPCB/IPC- 20/NGT/Poultry/2022/10270 dated 10/1/2022 Comments of Tehsildar report dated 04/07/2024 and 24.07.2024 Comments of Visiting officer. 1. 500 m from residential zone in order to avoid nuisance caused to odour and flies No approved residential area within 500 m radius of the site. However, there are 3 no. Deras having 5-6 houses only within 500 mtr radius. During visit, 7-8 number of residential houses were found within 500 mtr radius of site 2. 100 m from major water course like river, Lake, canals and drinking water source like wells, summer storage tanks in order to avoid contamination due to leakage /spillage There is no major water course like river, Lake, canals and drinking water source like wells, summer storage tanks within 200 m radius of the site. During visit, no water course like river, Lake, canals and drinking water source like wells, summer storage tanks was found in the radius of 100 m from the poultry farm. 3. 100 m from National Highway (NH) in order to avoid nuisance caused to odour and flies. There is no National Highway within 150-200 m radius of the site No National Highway (NH) was found in the radius of 100 m from the poultry farm. 4. 50 m from State Highway (SH) in order to avoid nuisance caused to odour and flies There is no State Highway within 100 m radius of the site No State Highway (SH) was found in the radius of 100 m from the poultry farm. 5. 10-15 m from rural roads/internal roads and village pagdandis. There is no rural roads and village pagdandis at a distance of 15 m from the site No, rural road was found in the radius of 10 m from the poultry farm. 6. Poultry sheds should not be located within 10 m from the farm boundary for cross ventilation and odour dispersion - The project proponent has provided boundary wall consisting of angel and sheet around the poultry farm with a distance of 10 mtr from the poultry shed. A copy of Tehsildar Report is attached herewith. It is also pertinent mention here that the complainants has also submitted a report from Tehsildar Patran dated 01.07.2024, the same is reproduced as under: ਤਸਦੀਕ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਆਪ ਜੀ ਦੇ ਹੁਕਮ ਮੁਤਾਬਿਕ ਪਿੰਡ ਸੇਰਗੜ੍ਹ, ਤਹਿਸੀਲ ਪਾਤੜਾ, ਜਿਲ੍ਹਾ ਪਟਿਆਲਾ ਪੁੱਜਾ ਮੋਕਾ ਦੇਖਿਆ ਗਿਆ ਮੁਤਾਬਿਕ ਖਸਰਾ ਨੰਬਰ 17//25 ਵਿੱਚ ਇੱਕ ਬਿਲਡਿੰਗ ਬਣੀ ਹੈ, ਜਿਸ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਰਿਹਾਇਸ਼ਾ ਹਨ। Now, to check the latest compliance, the site of the poultry farm was visited by the AEE of this office on 25.07.2024 and Sh. Chamkaur Singh, Proprietor of the farm and Sh. Davinder Singh, Sh. Harbans Singh, Sh. Jagtar Singh, etc. were contacted during visit. During visit, it was observed as under: 1. The project proponent has provided 1 no. shed of size 50 ft x 210 ft for proposed broiler farm. 2. The project proponent has not provided any birds at the site. 3. The project proponent has provided a pucca pit of size 5 ft x 5 ft for disposal of dead birds. 4. No major water course like river, lakes, canals & drinking water source is observed within 100 mtr radius of site. 5. No national highway & stack highway was observed within 100 mtr & 50 mtr respectively with the site. 6. No rural/internal road/pagdandi is observed within 15mtr of site. 7. The project proponent has provided a temporary boundary wall using angles & plastic sheet, which is situated at a distance more than 10 mtr. 8. During visit, 7-8 number of residential houses were found within 500 mtr radius of site. The detail as informed by the complainants is as under:- 1. 1 house at a distance of 210 mtr (approx), having following families (i) Sh. Harbans Singh S/o Pichora Singh (ii) Sh. Kulwant Singh S/o Pichora Singh (iii) Sh. Balwant Singh S/o Pichora Singh (iv) Jaskaran Singh (30 yrs) S/o Harbans Singh (v) Jaspal Singh S/o Harbans Singh (vi) Sh. Malkit Singh S/o Balwant Singh. The owners of house informed that 6 families are residing in this premises & requested to consider it 6 houses. 2. House of Sh. Davinder Singh S/o Harpal Singh at a distance of approx. (210 mtr) from poultry farm site. Sh. Varinder Singh also resides in same premises. 3. 1 house of Sh. Hardeep Singh S/o Harpal Singh at a distance of approx (210 mtr). 4. House of Sh. Jagtar Singh S/o Hazara Singh at a distance of 450 mtr (approx.). 5. 1 premises having 2 families of Sh. Hardeep Singh S/o Jagtar Singh, Sh. Satnam Singh S/o Jagtar Singh. The representative informed that these are 3 houses of 3 families. 6. 1 house of Sh. Mukhtiyar Singh S/o Hazara Singh, Sh. Bhupinder Singh S/o Mukhtiyar Singh & Sh. Sukhwinder Singh S/o Mukhtiyar Singh. 7. 1 new house is also constructed adjacent to house of Mukhtiyar Singh. The representative of house informed that house of Mukhtiyar Singh & Bhupinder Singh will live in new house. In the current guidelines issued by CPCB, installation of mechanical scrapper/be conveyer for the removal of bird droppings from the poultry shed has not been made mandatory However, it has been proposed that bird droppings are removed once in four to six months & sold to the farmers. Following methods have been proposed in the guidelines for the disposal and utilization of bird droppings. Sr. No Poultry Farms Methods for Disposal/Utilization of manure 1. Small Poultry Farms Composting 2. Medium & Large Poultry disposal/ utilization of manure Composting or Biogas production for farmers/litter Combination of any of the methods for disposal/utilization of manure/litter 3. Poultry Farms in Cluster Common facilities for Biogas production on Composting or their combination Further, Deptt. Of Housing & Urban Development, Govt. of Punjab vide its notification dated 6/5/2016 has laid down following policy for poultry farms. “In an endeavor to promote agriculture allied activities like poultry farming Dairy farming, pig farming, Fish farming, Bee keeping, Mushroom farming, Sericulture in the State of Punjab and to supplement the dwindling agriculture income of the farmer and to generate employment opportunities for the unemployed youth of the State, the Governor of Punjab is pleased to exempt aforesaid activities from taking permission of change of land use from the competent authority of the Govt. of Punjab. The promoters of these activities will not be required to take NOC from the competent authority for taking electricity connection from Punjab State Power Corporation Limited (PSPCL) or availing bank loan etc.” The poultry farm has also submitted approved building plans for the unit from a competent person approved from Director of Factories. As per the report of DTP Patiala & Tehsildar, Patran, the site of the poultry farm is complying with the general sitting guidelines as per notification CPCB letter no. CPCB/IPC-20/NGT/Poultry/2022/10270 dated 10/1/2022. However, as continuous complaints are being received in this office to stop the establishment and operation of the subject cited poultry farm. Therefore, it is recommended that Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for establishment & operational of a broiler farm of birds capacity @ 9500 for a short period of six months upto 31.12.2024 with following conditions. However, before granting the application a personal hearing be given to complaints as well as project proponent for redressal of the complaint. 1. The poultry farm shall increase the height of the boundary wall upto minimum 10 ft so as to avoid any nuisance to the nearby area / complainant house. 2. The poultry farm shall not increase its bird capacity without obtaining prior NOC/ varied consent to operate from the Board as well as without providing adequate pollution control measures. 3. The poultry farm shall adopt latest environmental guidelines for poultry farms issued by the CPCB in true letter and spirit. 4. The poultry farm shall ensure that there is no public nuisance polluted in the area due to activities within its premises. 5. The poultry farm shall comply with the guidelines of the Punjab Water Regulation and Development Authority (PWRDA). 6. The poultry farm shall comply with the environmental guidelines/code of practice prescribed by the Board/CPCB. 7. The poultry farm will maintain set back distance of 10 meter between poultry shed and boundary of the unit. 8. The poultry farm shall obtain necessary permissions from the concerned departments. 9. The poultry farm shall provide composting pits to process birds droppings into manure as per the procedure laid down in the guidelines. 10. The poultry farm shall make efforts to convert the hatchery waste (shells) into animal feed to supply as a source of calcium, especially for poultry feeds. 11. The poultry farm shall provide an appropriate holding tank to collect and utilize the waste water generated from the cleaning operation onto land for plantation. 12. The poultry farm shall provide proper treatment and disposal of manure, ventilation sheds, control of temperature, good sanitation, swift repairs of leak avoidance of feed spills, prompt removal of broken eggs and dead birds shall be ensured for control of flies in the poultry farms. The farm should have provisions of wire nettings, traps, fly-repellents, insecticides etc. 13. The poultry farm shall provide methods for the control of rodents, which may include Exclusion, Trapping Glue boards, Tracking powder, rodent proof doors and windows to eliminate rodents/pest infestation. 14. As per Bureau of Indian Standards 1374: 2007, on poultry feed specifies that the use of antibiotic growth promoters is not recommended in poultry feed. Hence use of antibiotics should not be mixed with feed or administered non-therapeutic purposes without prescription for diseased birds
