File Note: It is submitted that the industry is a small scale green category unit. The industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 without obtaining NOC for process of Electric emersion water heater & heating elements @ 5000 Numbers/Day by using SS Strips @ 250 Kgs/day, Magnisium Oxide Powder @ 150 Kgs/day, Arelite @ 1 Kgs/day and Bakelite connector @ 3000 Numbers/Day as raw material. The industry has submitted electricity bill as the proof of date of commissioning, wherein date of connection is declared as 02.05.2022, hence, date of commissioning considered as 02.05.2022. The industry has deposited consent fee amounting Rs. 23,200/- (Rs. 14,500/- as consent fee + Rs. 5800/- as penalty fee + Rs. 2900/- as NOC fee) vide UTR No. 822872715 dated 11.06.2024 under the Water Act, 1974 and Rs. 20,800/- (Rs. 14,500/- as consent fee + Rs. 5800/- as penalty fee + Rs. 500/- as application fee) vide UTR No. 412838620 dated 11.06.2024 under the Air Act, 1981, against the value of total fixed assets amounting Rs. 60.74 lakhs as per CA certificate dated 22.05.2024, which is adequate upto 30.04.2027. The industry has submitted Land Use Classification certificate issued by DTP, Sangrur vide memo no. 634 DTP(S)/LPM-141 dated 21.05.2024, according to which, site is located on a kacha rasta, 120 mtr away from Malerkotla Nabha Road. The site is located at revenue estate of Village Bir Ahmedabad having khasra no. 223/196/140 min/(10-0) measuring total land 1 bigha 7 bishwe 12 bishwaiya. It is also stated in this report that this industry has been adjusted as such as existing industry in the Industrial Zone as per Notified Master Plan Malerkotla. Site falls in the MC limit. The industry has now submitted an undertaking wherein it has submitted that there is no any electroplating process in this unit. The unit is doing only dry process in this unit and no trade effluent is being generated. Earlier, a complaint was received in this office made by the resident of Malerkotla regarding work & use of illegal acid and disposing of its trade effluent by unauthorized way, against this unit. To verify the facts, the site of the unit was visited by the officer of this office on 03.05.2024 and found not complying with the provisions of the Water Act, 1974 and the Air Act, 1981. Therefore, the industry was given personal hearing held before the CEE (B) on 12.06.2024 at ZO-II, Patiala, wherein, it was decided as under:- 1. The industry shall not operate both of its units namely M/s Punjab Heat Solution and M/s Punjab Heat Solution (Unit-I) without obtaining consents to operate of the Board under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 2. Environmental Engineer, Regional Office, Sangrur shall seal the electroplating machinery installed in either of the unit and shall process the consent cases after compliance of the decisions of hearing. The industry has already applied for fresh CTO for its new unit after shifting its water polluting process from this unit premises to new unit located in front of this unit (i.e. M/s Punjab Heat Solution). The CTO application of new unit has been processed separately. To verify the facts, the site of the unit was visited by the officer of this office on 30.07.2024 and it was observed as under:- 1. The industry is engaged in the process of manufacturing Electric emersion water heater & heating elements (Semi Products) 5000 Numbers/Day by using SS Strips @ 250 Kgs/day, Magnisium Oxide Powder @ 150 Kgs/day, Arelite @ 1 Kgs/day and Bakelite connector @ 3000 Numbers/Day as raw material for which it has installed non polluting machinery like cutting, molding etc. 2. The industry has not installed any air polluting machinery like D.G set, boiler/furnace etc. 3. Domestic effluent generated from the industry is being discharged into MC sewer after passing through septic tank. In view of above, it is recommended that the consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted upto 31.12.2026 (upto accumulative period) with usual conditions and special conditions that the industry shall submit building plan approved from competent person of Director of Factory within one month.
