File Note: Subject: Application for obtaining varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981-Jay Thakurji Multimetals Pvt. Ltd., Vill. Kumbra, Mandi Gobindgarh, Distt. Fatehgarh Sahib. It is submitted that the industry is medium scale orange category induction furnace unit was granted consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through vide no. CTOW/Fresh/FGS/2019/9689801 dated 18/04/2019 valid upto 30/09/2023 and CTOA/Renewal/FGS/2019/11588665 dated 18/12/2019 valid upto 30/09/2023 for the manufacturing of Steel Ingots @ 84 MTD. The industry was issued show cause notice under the provision of u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974, u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 and u/s 5 of Environment (Protection) Act, 1986 for violating the provision of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 alongwith personal hearing before the Chief Environmental Engineer (B) of the Board on 24.06.2024 wherein it was decided as under: 1. The industry shall get the design of side hood and its APCD re-evaluated from PSCST, Chandigarh, within one month to find out the cause for not achieving the 100% suction as well as prescribed standards. 2. The industry shall submit a feasibility report for the proposed pollution control measures to control the secondary emissions within one month from reputed agency/chartered institute along with pert chart with respect to the installation of the pollution control measures. 3. The industry shall apply for authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 under appropriate category, within 7 days. 4. Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry to verify the compliance made by the industry, collect the stack emission sample, immediately after one month. Proceedings of the same has been conveyed to the industry by ZO-II, Patiala vide letter No. 1637 dated 23.07.2024 for its compliance. The industry was earlier applied for renewal of its the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and consent deposited of Rs. 118800/- through vide no. AXOIC08887348562 dated 28/03/2024 (50% penalty i.e. Rs. 10800/-) as water consent fee and Rs. 118800/- through vide no. AXOIC08887350457 dated 28/03/2024 (50% penalty i.e. Rs. 10800) as air consent fee against the fixed assets of Rs. 1029.37 Lakhs as on 31/03/2024 as per CA certificate dated 11/02/2024 which is adequate upto 30/06/2029 as per order dated 29/10/2018. The industry has deposited of Rs. 18000/- vide UTR no. AXOIC08887352488 dated 28/03/2024 as NOC regularization fee which is adequate. Now, the industry has applied for varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of MS Ingots and Billets with CCM plant installed @ 84 MTD under orange category with requisite documents. Now the industry has installed CCM plant. To verify the compliance and the contents, the industry was visited by the AEE of this office on 26/07/2024 During the visit, it was observed as under: 1. The industry was in operation during the visit. 2. The industry has installed induction furnace of capacity 07 TPH and installed bag filter house as APCD which was also in operation. 3. The industry has engaging in the manufacturing of MS Ingots and Billets with CCM plant installed @ 84 MTD by using MS Scrap, C.I. Castings and Ferro Alloys @ 92 MTD. 4. The industry has installed energy meter on its APCD and its reading was 27390. 5. The industry has submitted the pert chart of APCD to control secondary emission generated from the process. 6. The industry has submitted the air emission analysis report analysed by M/s Imarat Engineering Lab, Patiala on 27/01/2024 as per the report the particulate matter is 119.61 mg/Nm3 which is within limits as per prescribed by the Board. 7. As per request of the industry the industry wants some time to comply with the proceeding of the personal hearing. 8. The industry has installed 1 no. D.G. set of capacity 125 KVA with canopy and adequate stack height. 9. There is no generation of trade effluent and only domestic effluent is being discharged onto land for plantation after passing through septic tank. Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: "The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries." PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 17 KLD. Considering 30 working days per month, ground water extraction will be 510 KL/month, which is more than 300 KL/month. The industry has not obtained permission from PWRDA. In view of above, if approved it is recommended that the varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of MS Ingots and Billets with CCM plant installed @ 84 MTD may be granted upto 30/09/2028 with suitable conditions and special conditions as under: 1. The industry shall comply with all the decisions of the Competent Authority of the Board taken during personal hearing on 24.06.2024 within stipulated period. 2. The industry shall submit the permission regarding ground water abstraction from Punjab Water Regulation and Development Authority (PWRDA) within one month. 3. The industry shall be liable to comply with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 4. The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD. 5. The industry shall not generate and discharge any kind of trade effluent. 6. The industry shall keep a qualified person to handle the operation and maintenance of the APCD.
