It was brought out that the industry was granted consent to operate under the provisions of Water Act, 1974 dated 27.07.2022 (valid upto 30.09.2025) for production of carbonated Juice @ 4000 ltr/day...................
The industry was granted 'consent to establish' (NOC) for expansion under the provisions of the Water Act, 1974 & Air Act, 1981 dated 03.03.2023 (Valid upto 02.03.2024) for production of carbonated Juice @ 30,000 Ltr/day, Mineral Water @ 10,000 Ltr/day & Packing Material @ 195 Kgs/day...................
The industry was visited by officer of the Board on 23.03.2024 and it was observed that:-..................
1. The industry was in operation during visit. During visit the washing of the bottling section was in operation along with filling of the juices in the bottles...................
2. The ETP installed was not in operation and the project proponent has also not installed any flow meter at outlet of ETP to verify the record regarding the operational status of the ETP...................
3. The domestic effluent after septic tank was found stagnated in the plantation area as no distribution network provided for the same...................
The industry auto-renewed the CTO under Water Act, 1974 and Air Act, 1981 vide no. CTO/Renewal/BTI/2024/25402842 & CTO/Renewal/BTI/2024/25401735 dated 12.04.2024 with validity upto 12.04.2027...................
Show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 was issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 18.04.2024, however no one from the industry attended the hearing but a reply was received, wherein it has been mentioned that all the shortcomings have been attended and consents to operate have been obtained under auto renewal policy of the Board. After considering the material facts on record & hearing the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that:-..................
1. The industry shall apply for obtaining varied 'consents to operate' under the provisions of the Water Act, 1974 & Air Act, 1981, within 10 days...................
2. Environmental Engineer, Regional Office, Bathinda shall visit the industry, verify the compliance at site and process the applications to be applied by the industry under the Water Act, 1974 & Air Act, 1981 on merits...................
The industry has now applied for obtaining varied CTOs under Water Act, 1974 and Air Act, 1981 for production of Carbonated juice @ 30000 ltr/ day & Mineral water @ 10000 ltr/ day...................
The industry was visited by the officer of the Board on 28.06.2024 and it was observed as under:–..................
1. The industry was not in operation...................
2. The ETP installed was not in operation during visit and was found completely dry. The untreated effluent was found disposed-off onto land for stagnation in the adjoining plantation area. The industry has not installed any water meter at outlet of ETP to adjudge the operation of the ETP...................
3. The industry has stated the manufacturing process of the packaging material and has installed 2 no. bottling machines(blowing). The industry has not applied for EPR registration under PWM Rules, 2016. A lot of waste plastic material was also found disposed in the premises...................
4. The industry has installed DG set @ 62.5 KVA without adequate stack height...................
Show cause notice before refusal of 'consents to operate' under the Water Act, 1974 & Air Act, 1981has been issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 18.07.2024...................
During hearing, the prop. of the industry attended the hearing and submitted written reply w.r.t. notice issued to it, which has been taken on record. He further submitted that the industry is seasonal industry and it operates as per market demand, presently only packaging unit is in operation and no production is being executed. ETP was not functioning properly and hence under maintenance for 07 days. Since our industry falls in MSME category and we were not aware about the requirement of EPR. Stack height will be increased as per requirement. Proper distribution of domestic waste will be done to avoid the stagnation of wastewater...................
After hearing, the prop. of the industry and the officer of the Board, the Senior Environmental Engineer of the Board decided that:-..................
1. The industry shall operate the unit for production of carbonated juices/mineral water only after proper operation of the ETP, which shall thereafter be operated regularly & scientifically with proper maintenance of record regarding generation/treatment of the entire effluent...................
2. The industry shall apply for obtaining EPR Registration as required under the Plastic Waste Management Rules, 2016, within 07 days...................
3. Environmental Engineer, Regional Office, Bathinda shall visit the industry, verify the compliance at site and process the consent applications applied by the industry under the Water Act, 1974 & Air Act, 1981, on merits...................
