It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/SGR/2024/25096152 dated 27.03.2024 and the Air Act, 1981 vide no. CTOA/Varied/SGR/2024/25096150 dated 27.03.2024, both valid upto 30/09/2028, for manufacturing of Sorted Raw Rice with Dryer @2.0TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category in the name of Sh. Satish Kumar, (Partner).
The industry vide their partnership executed on 14.05.2024 has submitted that:-
1. "Sh. Mahavir Singh,
2. Mrs. Saroj Rani,
3. Sh. Satish Kumar,
4. Sh. Rimpal Goyal,
5. Sh. Ankush Goyal and
6. Sh. Rasik Goyal Rai was carrying on business vide a regular partnership deed dated 01.05.2024. Now, the partners mentioned at Sr. no. 3 to 6 wants to retire from the firm and thus, partners mentioned at sr. no. 1 & 2 want to continue the business with effect from 14.05.2024.
The industry has submitted power of attorney, vide which Sh. Mahavir Singh becomes authorized signatory on behalf of firm.
Accordingly, the industry applied for obtaining varied consents to operate under the Water Act, 1974 & the Air Act, 1981, for the same production capacity i.e. Sorted Raw Rice with Dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material in the name of Sh. Mahavir Singh (Partner).
The fee already deposited by the industry in previous granted applications is adequate up to 30.09.2030 against gross fixed assets of 67.93 Lacs as on 31.05.2023 as per CA certificate dated 04.07.2023.
The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention & Control) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control) Act, 1974 andthe Air (Prevention & Control of Pollution) Act, 1981. The industry has also submitted undertaking regarding updation of APCD from time to time, in future as and when required by PPCB or Punjab Govt.
As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.
Further, it is intimated that there is no change in the underappreciated value of the fixed assets. No complaint is pending against the industry.
Keeping above in view, it is recommended that the varied consent to operate granted under the Water Act, 1974 and the the Air Act, 1981 on the name of Sh. Satish Kumar, (Partner), may be transferred to Sh. Mangat Rai upto 30.09.2030 for manufacturing of Sorted Raw Rice with Dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, under orange category, subject to certain conditions to be mentioned therein.
