It is intimated that earlier the brick kiln was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/TRT/2019/ 11443009 dated 18/10/2019, for manufacturing of Bricks & Tiles @ 7200000 Number/Year, which was valid up to 17/10/2024. Thereafter, the brick kiln has obtained Auto Generation of Renewal Certificate for Consent to Operate granted under the Air (Prevention & Control of Pollution) Act, 1981 issued vide no. CTO/Renewal/TRT/2024/26680494 dated 28/08/2024, which is valid up to 28/08/2029.
Now, the subject cited brick kiln has applied for obtaining fresh consent under Water (Prevention & Control of Pollution) Act, 1974 for same capacity.
Detail of the case are as under: -
1. The brick kiln has submitted CA certificate dated 05.08.2024, which it is gross value of fixed assets of Rs. 27.50 Lakhs. Accordingly, it has deposited Rs. 31,900/- vide UTR No. 000151191285 dated 21.08.2024 as consent fee under Water (Prevention & Control of Pollution) Act, 1974, to make fee adequate up to 30/09/2029 under Water Act, 1974 against the fixed assets of the industry below 50 Lakhs.
2. The brick kiln has already submitted Feasibility Report, Design and Drawing approved by CSIR Roorkee, regarding adoption of Induced Draft Technology and completion certificate vide drawing No. 19/250.
3. The Brick Kiln has also submitted Partnership Deed, Lease Deed etc.
4. The brick kiln has already adopted induced draft technology approved by CSIR.
5. The brick kiln has provided ID fan for induced draft.
6. The brick kiln has stabilized the approached road.
7. The brick kiln has provided porthole and sampling platform for collection of Air emission samples.
8. The brick kiln has planted fresh saplings around the boundary of brick kiln. However, the brick kiln needs to plant more trees to make it three rows as per code of practice.
9. The brick kiln has provided pulveriser for crushing of coal.
It is pertinent to mention here that Board issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Now in continuation to above orders Board has issued fresh orders vide no. 329 dated 14/9/2023 regarding to Auto generation of renewal of consent to establish / operate / Authorization of any category of Small-Scale industries / projects / Health Care Facilities (up to 50 beds) and Hazardous Waste generating industries.
Keeping in view of the above, if approved it is recommended that fresh consent to operate Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln for a period up to 30/09/2029 with the conditions as under:-
1. The brick kiln shall use 20% paddy straw pallet by replacing coal as per office order issued by the Board.
2. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
3. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
4. The brick kiln will plant adequate trees around the boundary of the Brick Kiln. |
