It is submitted that the subject cited rice sheller has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2023/21978016 dated 01.06.2023, valid upto 31.05.2024 for the manufacturing of Raw rice with dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, with certain conditions mentioned therein. No specific condition has been imposed in the consent to establish (NOC) w.r.t. siting guidelines………..
Thereafter, the industry had applied for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981. Accordingly, the industry was visited by this office on 12.03.2024 and it was observed as under:-………………
1. The rice sheller unit in operation during visit.
2. The industry has installed machinery of rice sheller, for which NOC has obtained by it.
3. The industry has installed cyclone as APCD with shelling section and paddy pre cleaner dryer section. All dust emitting points were connected with hooding system and dust emissions were emitting from the dehuskers, elevators and paddy pre cleaners.
4. The industry has provided wall of adequate length and height 15 ft around husk storage area.
5. The industry has provided septic tank for treatment of domestic effluent however has not provided provision to discharge the same onto land for irrigation.
6. The industry has not planted adequate trees along its boundary wall…….
As such, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and the Air Act, 1981. But, the industry failed to submit any reply to the show cause notice. Accordingly, the application for consent to operate under the Water Act, 1974 and the Air Act, 1981 were refused on 28.03.2024. ……………………………………..
Now, the industry has again applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for the manufacturing of Raw rice with dryer @ 5 TPH and Sorted Rice @ 5 TPH. The detail of case is as under:-
• The industry has already deposited Rs. 54,000/- vide UTR/Ref. No. N046242886645985 dated 15.02.2024 under the Water Act, 1974 and Rs. 54,000/- vide UTR/Ref. No. N046242886647753 dated 15.02.2024 under Air Act, 1981, against the fixed assets of Rs. 293.49 Lakhs as on 15.01.2024 as per CA certificate. Thus, the consent fee is adequate upto 30/09/2028 under each Acts………………………….
The industry was visited by this office on 30.08.2024 and it was observed as under:-
1. The rice sheller unit was not in operation as paddy off season.
2. The industry has installed machinery of rice sheller, for which NOC has obtained by it.
3. The industry has installed cyclone as APCD with shelling section and paddy pre cleaner dryer section. The industry has now connected all the dust emitting points with APCDs installed with the shelling section and paddy pre cleaner of dryer section.
4. The industry has provided wall of adequate length and height 15 ft around husk storage area.
5. The industry has provided septic tank for treatment of domestic effluent and has now made provision to discharge the same onto land for irrigation.
6. The industry has now planted adequate saplings along its boundary wall.
7. The industry has stabilized its vehicle movement area.
The industry is complying with the provisions of the Water Act, 1974 and the Air Act, 1981 as well as code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. …………………
Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2028 for operation of rice sheller unit to manufacture Raw rice with dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, subject to the suitable conditions and a specific condition that the industry will get its emissions analyzed from Board's lab, within one month. ……………..
