It is submitted that the industry has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a new industry unit for manufacturing of Plastic dana @ 2 MTD by using raw material Waste plastic @ 2 MTD.
Fee detail:
The industry has deposited Rs. 2900/- vide R. no. 41699977 dated 09.09.2024 including application form fee, against the cost of the project of Rs. 27.25 lakhs as per in the application form. The NOC fees deposited by the industry is adequate for one year.

Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 1813 dated 16.02.2022, wherein, it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧਿਨ ਹਵਾਲੇ ਤਹਿਤ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿਚ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਭਗਵਾਨਪੁਰ (ਹ.ਬ. 199) ਤਹਿਸੀਲ ਡੇਰਾਬੱਸੀ, ਜਿਲ੍ਹਾਂ ਐਸ.ਐ.ਐਸ ਨਗਰ ਵਿਖੇ ਪੈਦੇ ਖਸਰਾ ਨੰਬਰ 1084/1009/137(3-0) ਕੁੱਲ ਰਕਬਾ 0 ਕਨਾਲ 14 ਬਿਸਵੇ ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਗਰੇਟਰ ਮੋਹਾਲੀ ਡਿਵੈਲਪਮੈਂਟ ਰਿਜਨਲ ਪਲੈਨ ਅਨੁਸਾਰ ਐਫ.ਈ.ਜੈੱਡ ਜ਼ੋਨ ਅਧੀਨ ਪੈਂਦਾ ਹੈ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵਿਟੀ ਕਰਨ ਤੋਂ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮੰਨਜੂਰੀ ਇਸ ਵਿਭਾਗ ਅਤੇ ਹੋਰ ਵਿਭਾਂਗਾ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗੇ। ਉਪਰੋਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ਾ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੇ ਗਏ ਹਨ ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
As the site of the industry is located in F.E.Z Zone, thus, the site of the industry is suitable.
The industry has submitted a copy of registry dated 20.06.2018 executed between Sh. Kuljeet Kaur and Sh. Raj Kumar Banga, for khasra nos. 083/1006/135 (2-4), 1084/1009/137, (3-0), 1086/1012/139 (1-10), village Bhagwanpur, Tehsil Derabassi, SAS Nagar.
As per the details mentioned in the application form, Sh. Raj Banga is the proprietor of the unit.
Water Pollution:
The industry has not proposed to generate and discharge any trade effluent from the process. Domestic effluent @ 1.0 KLD shall be generated from the unit and the industry has proposed to use the same for onto land for plantation within premises after passing through septic tank.
Air pollution:
The industry has also proposed to install 01 no. DG set having capacity @ 25 KVA are equipped with canopy and stack of adequate height.
Visit:
Accordingly, the proposed site of the industry was visited on 05.09.2024 and it was observed as under:
1. The proposed site of the industry is located the revenue estate village Bhagwanpur, Derabassi.

Recommendations:
In view of above, if may approved, the industry may be granted ‘consent to establish’ under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for one year, with usual conditions & with following special conditions:
1. This NOC is granted only for establishment of a new industry unit for manufacturing of Plastic dana @ 2 MTD by using raw material Waste plastic @ 2 MTD.
2. The industry shall establish its industry in the Khasra No. 1084/1009/137(3-0) in the revenue estate of Village Bhagwanpur, Derabassi, as mentioned in the classification of land use issued by the DTP, SAS Nagar vide letter no. 1813 dated 16.02.2022.
3. The industry shall not generate and discharge any kind of trade effluent from its process. The industry shall discharge only domestic effluent onto land for plantation within premises, after passing through septic tank.
4. The industry shall not carry out any activity in its premises, which can change its category from Orange to Red, without prior permission of the Board.
5. The industry shall not use any single use plastic (SUP) item or plastic carry bags, as raw material in its premises, under any circumstances.
6. The industry shall provide adequate and appropriate APCD over the extruding machine to be installed in its premises for manufacturing of plastic dana.
7. The industry shall not use any fuel in its premises except HSD for operation of DG set of capacity 25 KVA.
8. The industry shall not install any boiler or furnace in its premises without prior permission of the Board.
9. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water, if need be.
10. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
11. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
12. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
13. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
14. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
15. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
16. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
