File Note:  The project proponent has again applied for obtaining consent to establish/NOC for the establishment of residential cum commercial cum industrial colony in an area of 37.354 Acres bearing khasra nos. 565/3/1, 566/1, 567/2, 568/2, 569, 570, 571, 572, 573, 574/1, 605/1, 606/1, 622, 1322/621, 1320/620, 623/1/3 and 624/2/1/1/3 having 233 residential plots and 40 commercial plots and 149 industrial plots through online on OCMMS, with requisite documents. 1. The PP has submitted copy of the land deeds in the name of the firm for 97 Kanals 6 Marlas, 80 Kanals and rest is on consent letters issued. 2. The PP has submitted copy of the approved layout plan vide no. 108-STP(B)/INDBP-BTI dated 19.1.2024 as per which industrial plots @ 149 will be developed in 23.988 Acres, Residential plots @ 233 no. will be developed in 11.14 Acres, commercial plots @ 40 nos will be developed in the 2.226 Acres. The PP has provided 1.33 Acres of green buffer area (50 feet wide) between industrial and residential area. 3. The Project is partnership firm and has submitted deed dated 16.3.2023. 4. As per the Feasibility report the total effluent generated is 661 KLD at full capacity and has proposed STP @661KLD based on MBBR Tech having components @ Bar Screen, Collection tank, Aeration tank, Clarifier, multimedia filters, sludge drying beds which is adequate in principle. 5. The PP has submitted copy of the letter issued by BDA vide no. 1196 dated 11.3.2024f or technically approving the industrial park and its layout. 6. The PP has submitted copy of the registered land lease dated 16.4.2024 for 42 kanals, 13 Marlas bearing khasra nos. 1317/619(23-1), 1319/620(19-12) for 8 years for disposal of the treated effluent onto land for plantation. Also submitted copy of its jamabandi. As per the copy of latha the land is adj. to the project. 7. The PP has submitted undertaking stating that : I, Pranav Gupta s/o Prem Chand Gupta r/o #13303, Shiv Mandir Lane, Shiv Colony, Barnala Road Bathinda. Punjab-151001, Promoter and Partner of Pioneer Associates do hereby solemnly affirm and declare as under :- 1. We established industrial park in the name of Alvista Tech Park" at dabwali road, village gurusar sainewala. Distt. Bathinda. Punjab-151001. 2. We will not provide any air polluting unit in the plot no. i1 to i6. 3. We will not allow any unit to discharge effluent and shall insert condition in the sale deed that the unit will make ZLD arrangement for trade effluent. 4. We will not allow any unit of any kind having process covered under the EIA, 2006. 5. We will impose condition in the sale deed that no owner of the plot shall install industry of any kind having process covered under the EIA, 2006 8. As per the proposed layout plan; total residential saleable area of the project is (27966.135sqm) 33447.22 sqyds, industrial saleable area is (48425.737 sqm) 57916.7 sqyds and commercial saleable area is 4259.66 sqm (7734.85 sqm-FAR). As per max FAR the max built-up area permissible comes to be (2.1 * 27966.135) + 7734.85+ 48425.737 = 114889.47 sqm which is less than 1,50,000 sqm. As such the project seems to be not covered under EIA notification 2006. 9. The PP has submitted copy of the letter from Senior Town Planner, Department of Town and Country Planning, Bathinda stating that: ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਆਪ ਵੱਲੋਂ ਮੰਗੀ ਗਈ ਸੂਚਨਾ ਸਬੰਧੀ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਯੂਨੀਫਾਈਡ ਜ਼ੋਨਿੰਗ ਰੈਗੂਲੇਸ਼ਨਜ਼-2018 ਦੇ ਅਨੈਕਸਚਰ-ਏ ਦੇ ਕਲਾਜ਼ 2.5 ਨੂੰ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਲਿਖਿਆ ਗਿਆ ਹੈ। "Minimum buffer of 15 meters' green belt of broad leaf trees should be provided around the boundary of village abadi's falling in the industrial zone of Master Plan. A buffer strip of 15 meters of broad leaf trees shall also be provided between residential areas and red category industries falling in the industrial zone of Master Plan boundaries of which are located within 100m from the boundary of such areas. It is clarified that 15 meter buffer shall be provided by the owner of the project who comes later" "All residential colonies, commercial establishments like shopping malls, multiplexes, etc. shall maintain a minimum distance of 250 m from the hazardous (Maximum Accident Hazardous or MAH) industries notified by the competent authority. The distance shall be measured from source of pollution/hazard in the industrial premises to the nearest building lines as per zoning plan of the colony/complex. However, for specified type of industry like rice Sheller/sella plants, stone crushers, hot mix plants, brick kilns, etc., standards/norms of distance as prescribed by PPCB or any other concerned agency shall apply." As per the above letter the PP need not provide any green belt from the residential site of the project towards the Boundary of the project in the industrial area however the industry which comes in vicinity(100 m) outside the Project boundary is required to provide the green buffer zone . The project proponent has deposited NOC fee of Rs. 56400/- through online vide R.No. 31311271 dated 01.04.2024 against the proposed project cost of Rs. 2452 lacs, which is adequate for 1 year.  The site of the PP was visited by AEE of this office on 31.8.2024 and it was observed as under: - 1. The site falls on the right hand side of the Bathinda to Dabwali road. 2. The PP has made boundary wall and secured the land of the colony. The project is surrounded by the agricultural fields on all sides. 3. The site of the Project is not located in any MC limit. 4. The PP has provided 50 feet wide buffer green zone between the industrial and residential zone of the project. The PP has not provided any green buffer zone between the industrial plots i1 to i6 and commercial plots however has submitted undertaking that no air polluting unit shall be allowed in the plot no. i1 to i6. 5. The project proponent has proposed to generate maximum 661 KLD of domestic effluent from the whole project and has proposed to dispose-off its treated water for reuse in Flushing by dual Plumbing(25%- 165.25), gardening, onto land for plantation (500 KLD). 6. The land available for use of treated effluent is 5.6 Acres which can accommodate @661 KLD effluent after flushing. The PP has proposed to dispose off the remaining 500 KLD onto land for plantation in the land area 29 k 14 m taken on lease for development as per karnal technology. 7. There is no rice sheller/BKO/HMP in 100-meter radius, MAH within 250-meter radius and air polluting industry within 100-meter radius of the proposed industry. 8. The project proponent has not proposed any DG set. The site of the colony is suitable for the establishment and proposal submitted by the project proponent is adequate as per the Water Act, 1974 & Air Act, 1981. Keeping in view of above it is recommended that the application submitted by the PP may be considered and the PP may be granted of the Consent to establish/NOC for the project for the residential cum commercial cum industrial colony in an area of 37.354 Acres bearing khasra nos. 565/3/1, 566/1, 567/2, 568/2, 569, 570, 571, 572, 573, 574/1, 605/1, 606/1, 622, 1322/621, 1320/620, 623/1/3 and 624/2/1/1/3 having 233 residential plots and 40 commercial plots and 149 industrial plots with validity for 1 year, with suitable conditions along with special conditions that: 1. This NOC is valid for establishment of residential cum commercial cum industrial colony in an area of 37.354 Acres having 233 residential plots and 40 commercial plots and 149 industrial plots. 2. The PP will not provide any air polluting unit in the plot no. i1 to i6 and shall make this condition as the part of the allotment letter/ sale deed to the owner of the above plots. 3. The PP will not allow industrial unit of any kind to be established in the Project to discharge any trade effluent and shall make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots. 4. In case any water polluting unit is allowed it will be sole responsibility of the PP to ensure that the industrial unit will make ZLD arrangement for trade effluent and shall make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots. 5. The PP will not allow unit of any kind having processes covered under the EIA, 2006 and shall make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots. 6. The PP will not allow unit of any kind having processes covered under the press note 17 of (1984 series) and requiring site clearance u/s 41-A of the Factories Act, 1948 from SCA-cum-SAC and shall make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots. 7. In case any unit having process covered under the EIA Notification, 2006 is allowed in the Project it will be sole responsibility of the PP to obtain Environmental Clearance under the EIA Notification, 2006 for the whole project before-hand. 8. The PP will make the individual industrial units bound to obtain separate Consents to Operate under the provisions of the Water Act, 1974 and Air Act, 1981 from the Board and shall make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots. 9. The PP will lay pipeline and distribution network on its own cost leading to the area reserved for disposal of the treated effluent for plantation area to be developed as per karnal technology. 10. The PP will not allow any polluting unit/ industry to be set up in the premises and only commercial shops will be established. 11. The PP will not alter / change / expand its approved layout plan without prior permission from the Board and the built-up area under the project shall not exceed 1,50,000 sq.mtr. 12. The PP shall be bound to obtain Environmental Clearance from the concerned authorities in case the built-up exceeds 1,50,000 sq.mtr. 13. The PP shall utilize the treated effluent from the nearby STP for construction purposes and shall restrict usage of fresh water. The project proponent shall submit an agreement in this regard within 10 days. 14. The PP shall provide dual plumbing line for utilization of treated effluent for flushing purposes. 15. The promoter company shall ensure the compliance of conditions that only roof top rainwater shall be discharged into rainwater harvesting system, no surface run off or any other rainwater flowing in lawns garden be allowed to enter into the rain water harvesting system, and All the pipes provided for the recharging system should be visible and properly colored. 16. The PP will manage its solid waste generated in-house as per the guidelines laid in the Solid Waste Rules, 2016. 17. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity. 18. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 19. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. Competency: Chairman
