Adequacy of consent fee The consent fee is adequate upto 31/12/2025 under the both acts as per Board's Office Order dated 29/10/2018 and NOC regularization charges.
Visit:
Accordingly, show cause notice for cancellation of consent to operate granted under the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before the Chairman of the Board on 12/04/2024 vide Board’s letter no. 5459 dated 28.03.2024. After hearing, it was deiced as under:
1. The consent to operate auto renewed by the industry under Air (Prevention & Control of Pollution) Act, 1981 be cancelled.
2. The industry shall immediately shift to PNG as fuel in compliance to Hon’ble NGT orders as well as Notified State Fuel Policy.
3. The industry shall submit an Environmental Compensation amounting to Rs. 2.0 Lakh within 15 days on best assessment judgement basis.
4. The industry shall submit bank guarantee amounting to Rs. 3.0 lakh within 7 days, as an assurance to comply with the Environmental Laws.
5. The Environmental Engineer (Computers) shall put a patch on the OCMMS ID of the industry, so as to restrict it from obtaining the auto renewal consent under the Air (Prevention & Control of Pollution) Act, 1981.
6. The Regional Office, Fatehgarh Sahib shall submit report regarding compliance of above said directions by 30th June 2024 and based on that report of Regional Office, further action in accordance with Law shall be taken.
The proceedings were conveyed to the industry vide Board’s letter no.526-27 dated 14.05.2024 for compliance.
The industry has issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 vide Board’s letter no. 2131 dated 19.08.2024 is hereby directs as under:
"That the industry shall not operate its unit, without complying with the decisions of hearing held on 12-04-2024 and without obtaining the consent of the Board".
Now, the industry has applied for varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has using only PNG as fuel.
Moreover, no complaint has been received/pending in this office. The industry is complying with consent conditions under both acts with Environmental laws.
Further, it is intimated that now the industry has not required to be obtained EC/TORs as the Govt. of India, MoEF & CC issued notification dated 07.06.2024 for exemption of such type of industry for obtaining Environment Clearance under EIA notification dated 14/09/2006.
The industry has submitted that our unit is obtaining and installed PNG connection in our unit and we will be running the unit through PNG in our mill but the industry closed near about one month. We have already sent the mail due to change the industry profile Orange to Green Category. Please give me permission from running the unit through PNG as fuel and issued show cause notice to issue under Water Act, 1974 and the Air Act, 1981 and decided that your office decided to penalty amounting to Rs. 5.0 lakh (2 lakhs as Environmental Clearance and 3 lakhs as Bank Guarantee) we want to inform that you have given us 2 lakh rupees as environmental compensation and 3 lakh rupees as bank guarantee, please exempt us from this.
It is further intimated that the industry has filed appeal before the Appellate Authority against the Board order and next date of hearing has been fixed on 30/09/2024.
To verify the contents, the industry was visited by the AEE of this office on 17/09/2024. During the visit, it was observed as under:
1. The industry was in operation during the visit.
2. The industry has installed 01 no. of reverberatory furnace and using PNG as fuel.
3. The industry has engaging in the manufacturing of M.S Bars, Round, Square etc. @ 19 MTD by using Steel Ingots, Runner Risers (bones) etc. 20 MTD.
4. There is no coal pulverizer available at site.
5. The industry has not installed any DG set.
6. No generation of trade effluent as whole of the water used for the cooling purposes is being re-circulated.
7. There is only generation of domestic effluent which is being discharged into MC Sewer.
PWRDA Permissions:
In the subject cited case, the industry has mentioned ground water extraction @ 6 KLD. Considering 25 working days per month, ground water extraction will be 150 KL/month, which is less than 300 KL/month. The industry has no need for obtained permission from PWRDA.
Recommendations:
In view of above, if approved it is recommended that the varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of M.S Bars, Round, Square etc. @ 19 MTD by using Steel Ingots, Runner Risers (bones) etc. 20 MTD for consideration, please.
