It is submitted that the establishment is a large scale green category unit, engaged in activity of storage and distribution of various petroleum products and lastly, was granted varied consent to operate (to increase in the storage capacity of Ethanol from 20 KLD to 55 KLD) under Water Act, 1974 vide no. CTOW/Varied/SGR/2023/22070887 dated 28/07/2023 and under Air Act, 1981 vides no. CTOA/Varied/SGR/2023/22070849 dated 28/07/2023, both are valid upto 31/03/2028 for storage of Motor Spirit (M.S) @ 400 KLD, Superior kerosene oil (SKO) @ 80 KLD, High Speed Diesel @ 2000 KLD and Ethanol @ 20 KLD, subject to certain conditions mentioned therein.
Later, the industry vide its e-mail dated 14.05.2024 (copy enclosed) has informed this office that the industry has been granted PESO license by PESO Department for quantities mentioned in unit ‘KL’ for individual Class-A and Class-B product. However, earlier consents issued by the Board depicted quantities in 'KLD'. Accordingly, the industry has requested to provide a provision to fill quantities of raw material and product in unit 'KL', so that synchronize quantities mentioned in both the permissions i.e. CTO and PESO license. Further, it was informed that there has been no additional tanks/augmentation of tankage capacity/ Expansion of facility have been done since grant of last CTO Air & Water and PESO License. As on date also, Quantity mentioned in amended PESO license and PESO license which was approved and submitted during application of last CTO Air & Water is same as it is. Copy of previous amended PESO license and latest PESO license is attached as annexures.
This office accordingly has taken up the matter with Computer Section, Head Office, Patiala and has provided a provision to fill details of raw material and product in unit 'KL' apart from provision for other units as already provided therein.
Now, the industry has applied varied consent to operate under both the Acts for storage and distribution of petroleum products i.e. Petroleum Class A in bulk @ 36940 Kilo Liter and Petroleum Class B in bulk @ 66380 Kilo Liter with no increase in storage capacity in comparison to earlier granted consents.
The industry has already deposited consent fee as well as NOC regularization fee under both Acts as mentioned at serial no. (vii) in agenda note against the value of fixed assets i.e. Rs. 156.19 cr as on 31.03.2024, as per CA certificate dated 11.06.2024. The consent fee deposited by the industry under both the Acts is adequate upto 31.03.2028.
There is no addition in gross fixed assets of the industry as per latest CA certificate as on 31.03.2024 when compared with previously submitted CA certificate as on 31.03.2023 submitted by the industry. Hence, it is evident that there has been no increase in storage capacity. Further, it is also evident from PESO license issued to the industry dated 03.02.2022 wherein the industry was granted permission for storage of class A petroleum products @ 37010 KL & class B petroleum products @ 66380 KL. Now, as per latest PESO certificate dated 11.07.2023, the capacities for storage products remains the same. Therefore, the industry has applied for storage of petroleum products for quantities within the consented limit of PESO license considering a small decrease in class A petroleum products by 70 KL i.e. from 37010 KL to 36940 KL by removing a tank of capacity of 70 KL. However, the storage capacity for class B products remains the same.
To verify the submission of the industry, the industry was visited by officers of this office on 03.09.2024 and it was observed as under: -
1. The industry was in found in its operation with it expansion project by installing all its additional machinery.
2. The industry has provided total 17 tanks for storage of petroleum products i.e. MS, HSD & Ethanol.
3. The industry has provided collection chamber followed by Oil & Water Separator for treatment of trade effluent being generated, during the water draining operation from the storage tanks as & when required. This water is being accumulated at the bottom of storage tanks over a period of time during rainy season and due to moisture content in pipeline through which the product is received in the storage tanks. The industry has submitted analysis report dated 22.07.2024 from M/s Environment Pollution Analysis Lab. As per analysis report, concentration of various parameters (pH-7.12, TSS-14, BOD-6.4, COD-36.5, O&G-3.2) are within prescribed limit for plantation.
4. The industry has installed collection chamber followed by Oil & Water Separator for treatment of trade effluent being generated, during accidental leakage from tank trucks. The industry has submitted analysis report dated 22.07.2024 from M/s Environment Pollution Analysis Lab. As per analysis report, concentration of various parameters (pH-7.04, TSS-14, BOD-6.1, COD-34.78, O&G-2.8) are within prescribed limit for plantation.
5. The domestic effluent is being discharged onto land for plantation after passing through STP. The industry has submitted analysis report dated 22.07.2024 from M/s Environment Pollution Analysis Lab. As per analysis report, concentration of various parameters (pH-6.82, TSS-17, BOD-7.64, COD-43.5, O&G-5.6) are within prescribed limit for plantation.
6. The treated effluent is being discharged onto land for plantation into green belt within its premises having area more than one acre.
7. The industry has provided 2 no. DG sets of capacity 750 KVA each, both are equipped with canopies and adequate stack heights.
8. The industry has installed vapor recovery system for collection of MS (petrol) vapors. The vapors then absorb inside the vessel and then condensate processing is being followed for further converting into MS (petrol).
9. The industry is complying with the conditions imposed in the consents granted to it under the Water Act, 1974 & the Air Act, 1981.
In view of above, it is therefore, recommended that the varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may both be granted upto 31.03.2028 to the industry for storage and distribution of petroleum products i.e. Petroleum Class A in bulk @ 36940 Kilo Liter and Petroleum Class B in bulk @ 66380 Kilo Liter with usual conditions as per the policy of the Board and in supersession to earlier consents granted to the industry by the Board. |
