Subject: Proceedings of the personal hearing given by the Chairman of the Board on 12/09/2024 to M/s ADR Enterprises, Naudhrani Road, Near Petrol Pump, Malerkotla (CETP of 10 KLD capacity) to show cause notice for refusal of ‘Consent to Establish’ (NOC) applied Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention & Control of Pollution) Act, 1981.

The officers of the Board brought out that the CETP operator has applied for obtaining Consent to Establish of the Board (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act 1974 and under the Air (Prevention & Control of Pollution) Act 1981 for setting up a CETP of capacity 10 KLD at Naudhrani Road, Near Petrol Pump, Malerkotla outside the MC limits of Malerkotla under small scale red category. While processing the case, following observations have been made by the Competent Authority:
1. The CETP proposes to make plantation in 1000 sq.yds. for utilization of 8 KLD treated effluent and CETP is to be installed in balance area of 368.45 sq.yds. The industry has submitted sufficient clarification, as to whether is it feasible to install CETP in such a small area.
2. The industry is required to develop a green buffer of 10 mt. towards drain. This aspect has not been considered in the layout plan attached.
3. It has been mentioned in the project report that machinery of cost Rs.45.00 lacs would be installed. In the project report another figure of cost of machinery Rs.28.1 lacs have been mentioned. Moreover, details of the machinery proposed to the plant are not been given.
4. No. of columns in the NOC form has been left blank / incomplete details are given i.e. in Part-C, the details at Sr. No. 5,6,7 & 8 are not completely filled whereas, in Part-E left blank at Sr. No. 2 & 3.
5. The unit is a CETP unit and propose to treat trade effluent to be generated from electroplating industries with ZLD technology. Further, the CETP has proposed to utilize RO permeate @ 8 KLD onto land for plantation which is in contradictory to ZLD spirit of the CETP as per its proposal.
It is mandatory for the project proponent to submit all the required information in detail and technically correct information.
The matter has been considered by the Competent Authority and it has now been proposed to refuse the ‘Consent to Establish’ (NOC) applied under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause-cum-personal hearing, due to aforesaid observations. Accordingly, show cause notice for refusal of ‘Consent to Establish’ (NOC) applied under the Water Act, 1974 and Air Act, 1981 was issued to the CETP operator with an opportunity of personal hearing before the Chairman of the Board on 12/9/2024.
Sh. Deepak Kumar, Partner of the CETP attended the hearing and submitted a written reply, which was taken on record. They stated that they have made an agreement with M/s The Malerkotla Electroplating Association for treatment of the effluent collection by it from the electroplating / pickling industries and has proposed to install tertiary treatment comprising of RO and MEE for 10 KLD plant, which will require area les than 100 Sq.yard. Complete CETP machinery will be installed in an area of 150 Sq.yard. The CETP will fulfill the criteria regarding development of green buffer of 10 mts towards the drain and shall incorporate the same in the layout plan. The project report is duly signed by CA for total project of Rs. 48.60 lakh. The incompletion has already been amended by the CETP. The CETP has proposed to discharge RO permeate only for plantation purpose. They have failed to give any satisfactory reply w.r.t. filling incomplete application online.
After hearing the officers of the Board and representative of the CETP, the Chairman of the Board decided as under:
1. The CETP shall submit the revised proposal for utilization of RO permeate within one month to achieve ZLD condition as per the proposal of the CETP.
2. Environmental Engineer, Regional Office, Sangrur shall return the NOC application of the CETP and CETP shall re-submit the application compete in all respects to the Board
If approved, the proceedings may be conveyed to the industry as well as Regional Office for ensuring compliance, please.
