Subject: Application for obtaining fresh Consent to Operate under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 - M/s Bharatgarh Farms Fresh (Sarai), Bharatgarh, Distt. Ropar.
It is submitted that the hotel was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/RPN/2019/10333675 dated 14.09.2019 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/RPN/2019/10333006 dated 14.09.2019 both were valid upto 13.03.2020 for Restaurant for the gathering approx. 200 persons/day under the green category with subject to suitable condition and special conditions mentioned therein.
Thereafter, the industry has got its auto renewal consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/RPN/2021/15386481 dated 04.05.2021 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2021/15386328 dated 04.05.2021 both were valid upto 31.12.2021 for Restaurant for the gathering approx. 200 persons/day under the green category with subject to suitable condition and special conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Restaurant of capacity @ 200 Person/day and Rooms @ 20/per day under orange category along with requisite documents and fee.
The hotel has submitted the feasibility report, compliance of previous consent and consent fee., jamabandi, site plan, CA certificate wherein the value of fixed assets of the hotel as on 31.03.2024 is of Rs. 60.45 lakhs with the value of plant and machinery of Rs. 2.89 lakhs.
The industry has deposited Rs. 18000 vide R. No. 491402728 dated 18.10.2024, Rs. 10800 vide R. No. 117964511 dated 23.10.2024 under the Air Act, 1981 and Rs. 18000 vide R. No. 779241962 dated 18.10.2024, Rs. 10800 vide R. No. 490415246 dated 23.10.2024 under the Water Act, 1974. The fee deposited by the hotel is adequate upto 31.12.2026 including penalty for late fee submission.
The unit has not obtained CLU/Site Suitability from the Competent Authority till date, however, has submitted a letter by DTP, Rupnagar vide no. 716-DTP(R)/MR-1 dated 16.07.2019. Further, the site is a part of notified LPA of Sri Anandpur Sahib, according to which the 200 m wide area adjoining to NH-21/205 where the site is located comes under Mix land use zone and establishment of hotel is allowed in mixed land use.
Accordingly, the site of the unit was visited by the AEE of this office on 05.11.2024 and it was observed as under:
1. The unit is a restaurant cum beer bar & was in operation during visit.
2. The unit has installed one submersible pump for fresh water supply, however, no record regarding consumption has been maintained by the unit.
3. The unit has provided STP of capacity @ 15 KLD to treat the wastewater being generated from kitchen & toilets and the treated domestic effluent is discharged onto land for plantation.
4. The samples were couldn’t be collected due to low effluent.
5. The kitchen waste is being given to the nearby piggery farm. The project proponent was advised to provide the mechanical composter
6. The unit has installed one D.G. set of capacity of 125 KVA and 82 KVA which are provided with canopy and adequate stack height.
In view of above, it is therefore recommended that ‘Consent to Operate’ under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for short term i.e. upto 30.09.2025 which may be extended for long term after the project proponent get its treated water samples analyzed by the Board subject to suitable conditions and following additional conditions that: -
1. The hotel will comply with guidelines for the Control of Pollution and Enforcement of Environmental norms for the individual establishment and area/clusters of restaurants/Hotels/Banquets etc. issued by the Board vide no. SEE(HQ-2)/2021/64 dated 02/02/2021, by 31/07/2021.
2. The hotel will not dispose off its untreated/treated effluent by any unauthorized means.
3. The hotel will keep the record of fresh water consumption, treated water through STP and water consumed in plantation area.
4. The project proponent shall provide the mechanical composter.
5. The unit shall ensure that the solid waste is handled and disposed of properly as per provision of Solid Waste Management Rules, 2016.
6. The unit shall comply with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000.
