It is intiamted that the industry was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 which is valid upto 30.09.2025 with conditions mentioned therein.
Thereafter, the brick kiln was visited by officer of the Board as per the directions issued by the Competent Authority to check the black smoke on 11.03.2024 and observed
1. Brick kiln found emittingthick black smoke.
2. Inadequate green belt along the boundary wall.
3. In-adequate sampling arrangements.
4. The BKO was using illegal fuel (Carbon) and found stored 150-200 Bags of Carbon.
5. The BKO was not usingPaddy Straw Pellets.
6. Un-stabilized the vehicle movement area inside the premises.
Accordingly, the brick kiln was given personal hearing before the worthy Chairman of the Board on 26.04.2024, wherein it was decided that:
1) The brick kiln shall deposit an environmental compensation amounting of Rs. 50000/- fro its failure to control black smoke from the stack of their brick kiln with the Regional Office, Hoshiarpur of the Board, within 15 days.
2) The brick kiln shall submit a Bank Guarantee amounting of Rs. 1.0 lac with the Regional Office, Hoshiarpur within 15 days as an assurance for not to emit black smoke from stack of their brick kiln, not to use banned/ unauthorized fuel and assurance to comply with the code of practice as prescribed by the Board as well as standard operating practices as prescribed by the Punjab State Council for Science and Technology while providing them the induced draft zig-zag technology.
3) The brick kiln shall not use any banned fuel/ unauthorized fuel and shall only use those fuels for which its has been grantred consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and which are recommended by the their technical provider (Punjab State Council for Science and Technology) whiel providing them induced draft zig=zag technology.
4) The Brick Kiln shall comply with the code of practice as prescribed by the Board and follow the fuel feeding practices specified by their technical provider (Punjab State Coucnil for Science and Technology) while providing them induced draft zig-zag techniology and provide necessary sampling infrastructure with its stack.
5) The Brick Kiln shall not emit any black smoke in future, failing which the Board will be at liberty to take action as deemed fit in the matter without giving any further notice.
6) The Brick Kiln shall make necessary arrangements to store the fuel in covered area so that the problem of wetting of fuel in rainy season or in foggy weather could be avoided.
But, the industry failed to submit the compliance of the decisions of the personal hearing. Accordingly, the directions for closure of unit were confirmed vide Board's letter no. 3813 dated 20.09.2024 to disconnect the electic connection of the industry.
In compliance, the PSPCL Authorities disconnected the electric connection of brick kiln vide TDCO No. 150629 dated 08.11.2024.
Now, the BKO has applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with request for restoration of electric connection.
The brick kiln has submitted CA Certificate, copy of TDCO, compliance of previous consents.
The brick kiln has deposited Rs. 37700/- and Rs. 14500/-. The fee deposited by the brick kiln is adequate upto 30.09.2029 under both Acts.
Accordingly, the brick kiln was visited by the officer of this office on 13.11.2024 and observed that the brick kiln was not in operation due to disconnection of electric connetion. The brick kiln has now provided fresh saplings around the boundary of brick kiln and has also stabilized the movement area. No illegal fuel found stored in the premises. The BKO is now complying with code of practice as well as with the decisions of personal hearing dated 26.04.2024 due to which the directions for closure were issued i.e. the BKO has now deposited Environmental Compensation amounting Rs. 50000/- and Bank guarantee of Rs. 1.00 lacs.
In view of above, it is recommended that:
1) Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the BKO for the period upto 30.09.2029.
2) The electric connection of the BKO may also be restored for further period.
3) Ammended directions for renewal of license may be issued to DFSC Hoshiarpur.
