File Note: Sir note attached below and agenda note attached . It is submitted that the subject cited industry is a small industry and established in June, 2020 without obtaining NOC of the Board and is presently operating without consents of the Board for manufacturing of PVC Garden Pipe @ 835 kg/Day and PVC Granules @ 625 kg/Day by using PVC Resin @ 400 kg/Day, CP Plasticiser @ 300 kg/Day, Calcium Carbonate @ 150 kg/Day, Colour Pigments @ 0.250 kg/Day, PVC Scrap @ 650 kg/Day as raw material under orange category. As per record file, the industry was visited by the officer of the Board on 30.08.2024 and contacted Sh. Piyush Gakhar, Proprietor of the industry. During visit, it was observed as under:- 1. The industry was in operation. 2. The industry is a PVC Garden pipes unit and is engaged in the manufacturing of PVC Garden pipes by using plastic granules, PVC resins and CPW as raw material. 3. The industry has installed 2 no. of extruder machines and 1 no. mixture machine. 4. The industry has not installed APCD. 5. Empty drums of CPW (Chlorinated Paraffin Wax) were found stored in open area. 6. The domestic effluent generated from premises is being discharged into sewer. The industry was issued notice to directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry vide Board's letter no. 3200 dated 17/09/2024 alongwith an opportunity to appear in person before the Chief Environmental Engineer (P) on 23/09/2024. After hearing, it was decided as under: - 1. The industry shall apply for obtaining consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 of the Board within 15 days. 2. Environmental Engineer, Regional Office, Patiala shall comment upon whether the activity of CPW storage by the industry is covered under the Manufacture, Storage and Import of Hazardous Chemical Rules, 1989. 3. Environmental Engineer, Regional Office, Patiala shall visit the industry, verify the compliance of the decisions of the hearing by the industry, process the applications of consents to operate to be applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 on merits. The proceedings of hearing were conveyed to the industry vide Board's letter no. 3448 dated 26.09.2024 for compliance. Now, the industry has applied for obtaining consents for the first time under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. The industry has submitted allotment letter from PSIEC, Patiala, which is reproduced as under: Further, the industry has deposited Rs. 26100/- vide Receipt No. 293352076 dated 17.10.2024 and Rs. 5800/- vide online receipt no. 979022854 dated 19.11.2024 as water consent fee and Rs. 26100/- vide Receipt No 311268698 dated 17.10.2024 and Rs. 5800/- vide online receipt no. 979022854 dated 19.11.2024 as air consent fee. The total consent fee deposited by the industry is adequate upto 30.09.2026 against the fixed assets of Rs. 44.25 lakh as on 30.09.2024 as per CA certificate dated 15.10.2024 submitted by the industry. The industry is also submitted allotment letter from PSIEC vide letter no. 22831 dated 18.12.2018 for the industrial plot C-112 at Focal Point, Patiala. To process the application, the industry was again visited by the officer of this office on 14.11.2024. During visit, it was observed that: 1. The industry was in operation. 2. The site of the industry is situated at Plot No. C-112, Focal Point, Patiala. 3. The industry has installed 2 no. extruder machine and 2 no. agro mixers in the unit for manufacturing of PVC garden pipe by using PVC Resin, CP Plasticiser, Calcium Carbonate, Colour Pigments and PVC Scrap and CPW as a raw material. 4. The industry has installed water scrubber as APCD to control the process emissions generated from extruder machine and agro mixture, which was in operation at the time of visit. 5. No source of trade effluent from the process and the industry is discharging its domestic effluent into PSIEC sewer. As mentioned above, the industry is using Chlorinated Paraffin Wax as one of its raw material to manufacture gardening pipe and moreover Chlorinated Paraffin Wax is not hazardous in nature and hence is not covered under the ambit of HoWM Rules, 2016. The industry is now complying with the earlier observations made by this office and has also provided adequate pollution control devices. The industry is located in industrial Focal Point at Patiala and hence site is suitable for establishment for industry unit. In view of above, if approved, recommendations may be sent to SEE, ZO-1, Patiala for grant of fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 upto 30.09.2026 with suitable conditions as per the policy of the Board and following special conditions: (a) The industry shall not undertake washing of waste plastic and generate trade effluent. (b) The industry shall comply with PWRDA guidelines
