File Note: It is intimated that the industry has been issued show cause notice for refusal of ‘Consent to Operate’ applied under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, alongwith an opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 25.10.2024, wherein, it has been decided as under: 1. The industry shall submit bank guarantee amounting to Rs. 5.0 Lakhs as an assurance to comply with the environmental laws in future. 2. Environmental Engineer, RO, SAS Nagar shall visit the industry, verify the contentions made by the industry during the hearing and other environmental compliance and submit its report with concrete recommendations to decide the consent applications of the industry within 7- days positively. 3. Further action shall be taken after the receipt of the report from Regional Office, SAS Nagar. In compliance to decision no. 01 of the hearing, the industry has submitted a bank guarantee of Rs. 5.0 lakhs vide no. 035GT02243120015 dated 07.11.2024, having validity upto 15.11.2025. Now, the site of the project was by the AEE of this office visited on 20.11.2024 and it was observed as under: Sr. no. Previous observations Compliance status 1. The industry has not installed environmental data board at its entrance. The industry has now installed environmental data board at its entrance. 2. The industry has installed one no. tubewell in its premises and no flow meter is provided with the same. The industry has now installed flow meter with the tubewell installed in its premises. 3. The industry installed a skid mounted type STP for treatment of domestic effluent being generated from the unit. The STP was not in operation during visit. Stagnation was observed near the STP area. The aeration STP was operational during the visit 4. The industry has installed EMF meter at inlet and outlet of STP. However, the industry is not maintaining record of reading of flow meter. The industry has installed EMP meter a the outlet of STP and has now started maintaining record of readings of the same w.e.f. November 2024. As per the record maintained around 3-4 KLD of effluent is being treated in the STP. 5. The industry has mentioned in the application form that treated wastewater is used for flushing (duel plumbing) and plantation. However, no provision of duel plumbing is provided at the site. The industry has now carried out plantation along its boundary wall as well as inside its premises as green areas. The industry is also using treated wastewater for plantation purposes within premises. 6. The industry has developed some green area along its boundary wall but the industry is required to develop more plantation area in its premises. As per point no. 05 above. 7. The industry has installed one no. diesel fired furnace in its premises. However, stack of adequate height has not been provided with the same. The industry has now provided adequate stack height (3’ above roof level) with the diesel fired furnace in its premises. 8. The industry has provided one no. paint booth in its premises. However, no filters/water curtain as APCD has been provided with the paint booth. The industry has now provided filters in its paint booth for collection of painting residue. The industry has also executed an agreement dated 08.11.2024 with TSDF for lifting of hazardous waste. 9. The industry has kept hazardous waste of category 5.2 (used oily cloths) in a drums on backside of the unit and no dedicated hazardous waste room has been provided inside the premises. The industry has also not executed agreement with TSDF for lifting of hazardous waste. The industry has now kept hazardous waste of category 5.2 in a closed shed. The industry has now also executed an agreement dated 08.11.2024 with TSDF for lifting of hazardous waste. From above, it is clear that the industry has now complied with earlier observations for which show cause notice was issued by the Board. In view of above, if approved, the industry may be granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.09.2025, subject to suitable conditions and following additional conditions: 1. The industry shall not carry out any activity in its premises, which can change its category from Orange to Red, without prior permission of the Board. 2. The industry shall not use any fuel in its premises except diesel for operation of furnace and HSD for operation of DG set of capacity 1250 KVA. 3. The industry shall not install any new boiler or furnace in its premises without prior permission of the Board. 4. The industry shall not generate and discharge any kind of trade effluent from its process. The industry shall discharge only domestic effluent onto land for plantation within premises, after treatment in STP. 5. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 6. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water. 7. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 8. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 9. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 10. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 11. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 12. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency- Chief Environmental Engineer
