Sub:- Application for obtaining Fresh of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981-M/s Rajoa Agro, Village-Bahadarpur Rajoa, Tehsil-Batala, District-Gurdaspur.
It is intimated that earlier the consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & control of Pollution) Act, 1974 & Air (Prevention& control of Pollution) Act, 1981 granted vide online reference no. CTE/Fresh/GRP/2024/24908129 dated 14/02/2024, which is valid upto 13/02/2024 for the production of Raw Rice 5.2 Tonne/Hour, Rice Husk @ 1.50 T/Hour and Rice Bran @ 0.98 T/Hour by using Paddy @ 7.5 T/Hour under Orange Category.
Now, the industry has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 for the production of Raw Rice 5.2 T/Hour, Rice Husk @ 1.50 T/Hour and Rice Bran @ 0.98 T/Hour by using Paddy @ 7.5 T/Hour under orange category along with requisite documents.
The industry has deposited Rs. 108000/- & Rs. 111400/- vide R/No. 5561 dated 28/11/2024 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 2900/- as NOC regularization fee and Rs. 500 as Form Downloading Fee against the total gross value of fixed assets of Rs. 3,30,57,783.00 Lacs as on 30/09/2024 as per value of C.A. certificate submitted by the industry and same are adequate upto 30/09/2034 under both Acts.
As per details submitted the industry has installed 01 no. shelling section and 01 no. drier section and cyclones as APCD provided separately with these sections. The industry has also submitted Completion of the APCD installed.
The industry was visited by the AEE of this office on 29/11/2024 and observed as under:-
1. The Rice Sheller was in not operation during visit and was engaged in production of raw rice.
2. The Rice Sheller has installed 01 no. dryer, Paddy pre-cleaner, shelling section.
3. The Rice Sheller has provided 01 no. Cyclone with paddy pre-cleaner and 01 no. cyclone with shelling section as APCD.
Note:- The compliant has been received earlier regarding the width of the road and emissions of husk from the industry .
1. The matter regarding width of the road which has to be taken care by the Department of Country & Town Planner.
2. The matter of emissions of rice husk the industry has complying the code of practice as prescribed by the Board. Furthermore, the industry has taken the wall to the sufficient height as per norms issued by the Board, with that the matter of the husk emissions has been resolved by the industry. In future after the operation of the industry any violations regarding emissions came to notice the Board will take necessary action against industry.
Keeping in view of above, it is recommended that Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for a period upto 30/09/2034 for the production of Raw Rice 5.2 Tonne/Hour, Rice Husk @ 1.50 T/Hour and Rice Bran @ 0.98 T/Hour by using Paddy @ 7.5 T/Hour under with suitable conditions along with suitable conditions along with special condition that:-
1. The industry shall get its air emission samples from the Board for upcoming paddy processing season.
2. The consent to operate under the Water Act, 1974 and Air Act, 1981 has been granted to industry for same production capacity and plant and machinery as in previous consent, if there is any change in production capacity or any addition of any new plant and machinery, the industry shall obtain NOC expansion and revised consents accordingly with relevant documents from the Board under the said acts.
3. The consent to operate has been granted based on the documents submitted by the industry, if at any later stage the document submitted is found falls/misleading than the industry may be liable for necessary action as per Board’s policy.
4. The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan.
5. The industry will continue to comply with the new code of practice prescribed by Punjab Govt. Department of Science, Technology and Environment vide order no. 932 dated 15.10.2013.
6. The industry will get the building plan & site plan approved from the O/o Director of Factories under Factory Act, 1948 before the clearance case is considered by the Board.
7. The industry shall upgrade or install adequate air pollution control device to achieve the amended emission standard, if any amendment made. 8. The industry shall not make any expansion inside the present premises without obtaining prior permission from the Board.
