It is submitted that the industry a small scale orange category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDH2/2024/25508389 dated 23/05/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH2/2024/25509373 dated 23/05/2024 both valid upto 23/11/2024 for manufacturing of C.I CASTING/ M.S/ SG IRON @ 3.0 T/day.
Reason for earlier disconnection
Earlier, the industry was issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 for closure of industry (as industry has operated its cupola furnace after broken the seal imposed by the Board) vide Boards letter No. 1201-02 dated 22.02.2024 and the PSPCL authorities were directed to disconnect the supply of electricity available to the subject cited industry/premises with immediate effect vide Boards letter No. 1203-06 dated 22.02.2024.
Further, the industry has installed APCD as per design of PSCST, Chandigarh and Competent Authority of the Board vide no. 3056-57 dated 24.05.2024 has decided to issue direction u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 to restore the electric connection of the subject cited industry temporarily for six months i.e. upto 23.11.2024.
Now, it has applied for fresh 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along-with requisite documents through OCMMS. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 28.61 Lacs as on 30/09/2024 as per CA Certificate dated 29/11/2024, which is adequate upto 30/09/2029 as per Board's Office Order dated 29/10/2018.
The site of the industry was visited by the AEE on 22.11.2024 and it was observed as under:
1. The industry was in operation.
2. The manufacturing process involves: Raw material - Steel Scrap - Furnace Loading - Heating/Melting - Stag Removal - Alloying - Pouring - Cooling/Finishing - Final Product Steel Ingots.
3. The industry has installed 1 no. Cupola furnace of capacity < 3 Ton/hr. capacity and it has installed the APCD as design and drawing of PSCST, Chandigarh issued vide No. PSCST/TFD/35 dated 25.04.2024.
4. The industry has installed 02 shot blast machines with bag house filters as APCD with adequate stack height.
5. It is pertinent to mention here that in compliance to the directions of the Competent Authority of the Board the induction furnace installed by the industry without APCD has also been sealed by this office on 05.06.2024 and seal of said furnace was found intact during visit. The industry has currently to plan to operate its induction furnace as same was lying in abandoned condition.
6. It has installed a D.G. set of capacity 75 KVA which is equipped with canopy and adequate stack height.
7. There is no generation of trade effluent. Domestic effluent is discharged onto land for plantation through septic tank.
8. The industry has submitted building plan approved from competent person Er. Lokinder Bansal approved under Factories Act, 1948.
Site Suitability
There are no specific sitting guidelines for such type of industries. However, the subject cited industry is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana. The industry has submitted the Copy of CLU issued by STP Ludhiana vide his office letter no. 4613 STP(L)/TW-12A dated 29.10.2018 vide which the site of the industry falls in industrial zone as per Master Plan, Ludhiana (2007-31).
In the subject cited case, the industry has mentioned ground water extraction @ 5 KLD. Considering 25 working days per month, ground water extraction will be 125 KL/month, which is less than 300 KL/month.
The industry was found complying during visits on 08.05.2024, 20.09.2024 and 22.11.2024.
It is therefore recommended that:
1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2029 with suitable conditions as per policy of the Board. (Competency – Environmental Engineer being Cupola furnace < 3 Ton/hr. capacity)
2. Directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 may be issued to the PSPCL authorities for permanent restoration of electric connection. (Competency – Chairman of the Board)
