It is submitted that the project proponent has applied for obtaining fresh consent to operate under green category (3052-Hotels (up to 20 rooms and without boilers) and having waste water generation < 10 KLD and no hazardous waste generation) the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of hotel having @ 20 rooms, Banquet having capacity @ 50 persons & Restaurant having capacity @ 40 persons alongwith requisite documents.
The project proponent has deposited Rs. 24000/- vide UTR. No. 38042155311DC dated 24.10.2024 & Rs. 22400 vide UTR No. 579043909 dated 04.12.2024 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 19200/- vide UTR. No. 38042155312DC dated 24.10.2024 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate upto 31.03.2027 against the total cost of the project Rs. 173.57 lacs. The project proponent has submitted lease deed as a proof of date of commissioning (date of rent agreement: 01.04.2023).
The project proponent has submitted copy of letter issued by Office of Regional Deputy Director-cum-Competent Authority, Local Govt. Patiala under Papra to M/s Sky City Builders & Promoter Private Limited (Project: City Heart) vide letter no. 1196 dated 29.01.2014 regarding change of land use under sub-section (1) of section 81 of the Punjab Regional and Town Planning and Development Act, 1995 for Commercial Scheme is given below:

The project proponent has submitted layout plan approved by Competent Authority for SCO no. 77, City Heart, Kharar, SAS Nagar.
The project proponent has submitted lease deed executed between Mrs. Veerbati Yadav W/o Sh. Chandrakesh Yadav R/o H. No. 287, Tarai Vihar Colony, Fajalpur Maharaula , Rudarpur , Udam Singh Nagar, Uttarkhand (hereinafter referred to as the First Party/Landlord) and Mr. Hamendra singh S/o Sh. Chandrakesh Yadav R/o Flat No 613, Tower 4, South City, V.l.P Road, Zirakpur, District SAS Nagar (hereinafter referred to as the tenant). The lease deed is valid upto 31.03.2026.
The project proponent has submitted a copy of letter issued by Municipal Council, Kharar to M/s Sky City Builders & Promoters Pvt. Ltd. vide no. 954 dated 17.07.2014, in which, it has been mentioned that:
“The Municipal Council Kharar has no objection M/s Sky City Builders & Promoters Pvt. Ltd. Town Planning Scheme namely CITY HEART discharge its Sewerage treated water and solid waste as per norms made by Punjab Pollution Control Board at their own cost into the sewer system off Municipal Council Kharar after depositing charges framed by Govt. and as per Govt, instructions and rules of the Deptt. Of Local Govt, Punjab. NOC from Punjab Pollution Control Board will be taken by them separately at their own level. This NOC is being issued on the basis of undertaking given by the M/s Sky City Builders & Promoters Pvt. Ltd.”
It is pertinent to mention here that the project proponent i.e. “City Heart” developed by M/s Sky City Builders & Promoters (P) Limited was granted consent to established (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. O14SASCTE1616235 dated 04.09.2014 valid till 03.09.2015 for development of commercial project consisting of 90 SCOs in an area of 31645.34 sqm subject to certain terms and conditions mentioned therein. Further, the promoter company has been separately issued show cause notice vide this office letter no. 6453 dated 05.12.2024 to obtain consent to operate of the Board.
The site of the project was visited by the undersigned on 12.11.2024 and contact Sh. Hemendra Singh, Proprietor of the hotel. During the visit, it was observed as under:
1. The above project is a hotel and having 20 rooms capacity, Banquet having capacity @ 50 persons & Restaurant having capacity @ 40 persons.
2. The hotel has provided kitchen in the premises and oil & grease trap has been installed for the effluent generated from kitchen. The hotel has provided chimney for the suction of exhaust gases.
3. The effluent generated from the project is being discharged into septic tank followed by sewerage network of the commercial complex STP. Further, the treated effluent will be discharged to MC sewer.
4. The hotel has provided DG set of capacity 82.5 KVA with canopy and stack of adequate height on the roof top of the hotel.
In view of the above, may if approved, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2026 subject to suitable conditions and following additional conditions that:
1) The project proponent shall renew its lease deed before the expiry of the same.
2) The project proponent shall get its consents revised, if it increases the capacity of its restaurant/number of rooms.
3) The project proponent will comply with the mechanism/guidelines for control of pollution and enforcement of environmental norms at individual establishments and the area / cluster of restaurants / hotels / motels / banquets etc. framed by the CPCB and adopted by PPCB vide letter no. SEE(HQ-2)/2021/64 dated 02.02.2021.
4) The project proponent shall not carry out any activity in its premise, which can change the category of unit from Green to Orange/Red, without prior permission from the Board
5) The project proponent shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
6) The industry shall not start any new process within its unit which may change its category from Orange to Red, without the prior written permission of the Board.
7) The industry shall not consume any fuel for burning purpose except HSD for D.G. Sets without the prior written permission of the Board.
8) The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
9) The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
10) The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
11) The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
12) The project proponent shall devise the ways & means to minimize the generation of all kind of wastes through REDUCE, REUSE and RECYCLE activities. The generated waste, if any, shall be properly handled and managed as per the provisions of the Municipal Solid Waste Rules 2016 in an environmentally sound manner.
13) The project proponent shall develop the vermicomposting/composting to manage the biodegradable solid waste. The project proponent shall not throw, burn or bury any solid wastes in open, outside premises or in drain/ water bodies.
14) The project proponent shall ensure that there are no usages of plastic carry bags and single use plastic/ thermocol disposable items such as water bottles/ water pouches/ water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
15) The project proponent shall perform/ promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic (See attached banner/circular).
16) The project proponent shall carry out awareness and activities for the themes/ action points identified under Mission LiFE (Lifestyle for the Environment) by Ministry of Environment, Forests and Climate Change given at the website (http://missionlife-moefcc.nic.in).
17) The consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/ concerned person(s) in case information/ document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
18) In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
