File Note: It is intiamted that the brick kiln was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 which is valid upto 30.09.2026 with conditions mentioned therein. The industry has not obtained the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974. Now, the BKO has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The brick kiln has submitted CA Certificate, earlier granted consents, completion certificate issued by CSIR, Roorki vide dated 30.04.2019, coal of coal register verified by C.A. The brick kiln has deposited Rs. 34800/- vide UTR no. 375752312 dated 16.12.2024 and Rs. 17400/- under Air Act, 1981, Rs. 500 as application form fee, Rs 2900/- as NOC regularization fee vide UTR no. 928631278 dated 16.12.2024. The fee deposited by the brick kiln is adequate upto 30.09.2030 under both Acts. It is pertinent to mention here that Board issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Keeping, in view of above, may if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for the period upto 30.09.2029 with suitable terms and conditions and special condition that: a) The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. b) The consent is subject to the performance evaluation of new technology adopted by the brick kilns. c) The kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report. d) The brick kiln will pave the movement area around kiln with Bricks and provide the sampling arrangements before the coming season. e) The brick kiln shall not use of pet coke as fuel in its brick kiln. f) The BKO will comply with the directions u/s 18 (1) (b) of the Air (Prevention & Control of Pollution) Act, 1981 issued by CPCB. g) The BKO shall submit analysis report of Air emission during the coming season. h) The BKO shall provide proper green belt in coming monsoon season. i) The brick kiln will plant adequate trees around the boundary of the Brick Kiln. j) The brick kiln shall comply all the guidelines issued by Punjab Pollution Control Board/CPCB. k) The brick kiln shall comply with the directions u/s 5 of the Environment (Protection) Act, 1986 vide letter no. 10/574/2022-STE1/443 dated 04.11.2022 regarding replacement of 20% coal with paddy straw pallets as fuel.
