It is submitted that earlier the project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/18076631 dated 18.04.2022 which was valid upto 15.04.2023 for development of commercial project in an area of 25457.21 sqm having total built up area of 39661 sqm subject to certain terms and conditions mentioned therein. Thereafter, the project proponent was granted extension in the validity of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2023/18422789 dated 15.11.2023 valid till 14.04.2024 subject to suitable conditions and following special conditions that: 1. This CTE is valid for total built up area of 39661 sqm including construction of commercial project in an area of 25457.21 sqm. 2. The project proponent shall get its Environmental Clearance amended w.r.t. total built up area, within 03 months and shall submit a copy of the same to the Board. 3. The project proponent shall not carry out construction beyond 33918 sqm., without getting amendment in the Environmental Clearance, as mentioned in conditions no. 2 above. 4. The project proponent shall reuse treated wastewater @ 46 KLD for flushing system by providing dual plumbing system in its premises, as per the proposal submitted by it alongwith application form. 5. The project proponent shall develop 1 Kanal land area as per Karnal Technology for utilisation of treated wastewater for onto land for plantation, alongwith construction of project at the site. Thereafter, the project proponent was granted fresh partial consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2023/24148984 dated 27.11.2023 valid till 12.11.2024 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2023/24148975 dated 27.11.2023 valid till 12.11.2024 for Operation & Occupancy of one Drive Through Outlet within project (of McDonalds Franchise) subject to suitable conditions and following special conditions that: 1. This consent to operate is valid only for Operation & Occupancy of one Drive Through Outlet within project (of McDonalds Franchise) and no renewal / varied consent to operate will be granted to the project proponent until, it submits copy of amended Environmental Clearance as per point no. 2 mentioned below. 2. The project proponent shall get its Environmental Clearance amended w.r.t. total built up area, within 03 months and shall submit a copy of the same to the Board. 3. The project proponent shall not carry out construction beyond 33918 sqm., without getting amendment in the Environmental Clearance, as mentioned in conditions no. 2 above. 4. The project proponent shall reuse treated wastewater for flushing system by providing dual plumbing system in its premises, as per the proposal submitted by it alongwith application form. 5. The project proponent shall develop 1 Kanal land area as per Karnal Technology for utilization of treated wastewater for onto land for plantation, alongwith construction of project at the site. 6. The project proponent shall install mechanical composter of adequate capacity for the composting of biodegradable solid waste to be generated from the project, as per the provisions of the Solid Waste Management Rules, 2016. 7. The project proponent shall adopt an animal (Elephant/ Hippopotamus/ Royal Bengal Tiger/ Indian Lion) for at least five years at Chattbir Zoo under CSR activities and submit report within one month. 8. The project proponent shall start carrying out complete water auditing of the project on daily basis, immediately, so that the quantity of freshwater consumed and treated effluent utilised for activities like irrigation, dual plumbing, construction purpose can be assessed. 9. The project proponent shall provide separate flow meters after STP on channels/ pipelines carrying treated effluent for reuse in dual plumbing, discharge onto green area and disposal into MC sewer, if not already provided and maintain record regarding the same. 10. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 11. The project proponent will ensure time bound compliance of the CER activities mentioned in the conditions of the Environment Clearance granted under the provisions of the EIA notification, 14/09/2006. 12. The project proponent shall not consume any fuel except HSD in its installed DG set (s), without obtaining prior written permission from the Board. 13. The project proponent will comply with the provisions of MSW Rules, 2016. 14. The project proponent shall ensure at source segregation of the solid waste to be generated from its premises, at all times. 15. For biodegradable waste to be generated from the premises, the project proponent shall install mechanical organic waste composter(s) of adequate capacity within a period of three months. 16. The project proponent shall get the non-biodegradable solid waste disposed of at authorised site only, after obtaining permission from the Competent Authority and shall maintain proper record of disposal of the same, at all times. 17. The project proponent shall place adequate no. of storage bins in its premises, from where the municipal solid waste shall be got lifted and transported by the operator of the integrated MSW management facility as and when the facility is established and made operational. 18. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 19. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form. 20. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 21. The project proponent will comply with the provisions of E-waste Management Rules, 2016. 22. The project proponent shall ensure that its activities does not create any nuisance in the surrounding areas and no public complaints are received. 23. The Consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 24. In case the institute fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. Now, the project proponent has applied for varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of commercial project expect hotel alongwith requisite documents. On scrutiny of the application, following observations were made and accordingly, the project proponent was requested to submit the reply to the clarification. The project proponent has submitted its reply and same is reproduced below: S. No. Observations Reply Remarks 1. The project proponent has not filled complete application form i.e. PART-B: TECHNICAL INFORMATION (GENERAL) for which they have applied for consents. Except Hotel we have applied for Consent to operate. - 2. The project proponent needs to submit amended Environmental Clearance w.r.t. total built up area as per special conditions no. 2 of the earlier consent to operate granted by the Board. Builtup area is mentioned in the EC so the amended EC is not required. As per the EC second page, the built up area is mentioned as 33918 sqm whereas, in the subsequent pages i.e. page no. 5, the built up area is 39918 sqm which is same as approved layout plan area i.e. 39918 sqm. Further, there is a hotel being built upto 5th floor within the commercial project as per the approved layout plan and the built up area of the same has been considered in the total built up area The project proponent has deposited Rs. 151200/- vide R. No. 475679775 dated 16.12.2024 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 151200/- vide R. No. 289298759 dated 16.12.2024 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate for two years against the total cost of the project Rs. 4280.29 lacs. The project proponent has submitted compliance of the conditions of the earlier granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as Environmental Clearance granted by the Board. The site of the project was visited by the undersigned on 18.12.2024 and contacted Sh. Dinesh Kumar, Project Engineer. During the visit, it was observed as under: 1. The project proponent has completed construction work of commercial project and construction work of hotel is going on. 26 no. booths have not been occupied. Further, the commercial project has been built upto 2nd floor with configuration of LG+UG+FF+SF. Further, the construction work of hotel upto 5th floor is under progress. 2. The project proponent has already installed STP of capacity 75 KLD which was in operation and the samples were collected and sent to Head Office laboratory. Results of the same are still awaited. The flow meter reading was noted as 655 m3. 3. The project proponent has installed flow meter at the outlet of submersible, the reading was noted as 28355 m3 and as per record maintained the daily water consumption is about 20-25 KLD. 4. The project proponent has provided dual plumbing for utilization of treated wastewater. However, it has not yet developed 1 Kanal land as per Karnal Technology and treated water is currently being utilized for gardening & construction purposes. 5. The project proponent has not yet installed mechanical composter. 6. The project proponent is complying with the conditions of the earlier granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. In view of the above, may if approved, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be extended upto 31.12.2026 subject to suitable conditions. 1. The project proponent shall obtain corrigendum in Environmental Clearance regarding total built up area of 39918 sqm & hotel detail in population column of EC with configuration upto 5th floor, within 03 months and shall submit a copy of the same to the Board. 2. The project proponent shall reuse treated wastewater for flushing system in its premises, as per the proposal submitted by it alongwith application form. 3. The project proponent shall develop 1 Kanal land area as per Karnal Technology for utilization of treated wastewater for onto land for plantation, within 1 month. 4. The project proponent shall install mechanical composter of adequate capacity for the composting of biodegradable solid waste to be generated from the project within 1 month. 5. The project proponent shall adopt an animal (Elephant/ Hippopotamus/ Royal Bengal Tiger/ Indian Lion) for at least five years at Chattbir Zoo under CSR activities and submit report within one month. 6.
