The project proponent was issued show cause notice before refusal of consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 18.11.2024, wherein it was decided that: -
1. The project proponent shall submit permission from MC, Barnala to discharge the treated domestic effluent into sewer clearly mentioning the quantity of permitted discharge. ........................
2. The project proponent shall operate the STP efficiently so as to meet with the prescribed standards.....................................
3. The Environmental Engineer, Regional Office, Moga shall visit the project to verify its contentions and comment upon whether the consent has been applied for the same no. of flats which have now been proposed by the project proponent. He shall also collect the waste water samples from the outlet of STP and process the consent applications on merit, after commenting on the status of adjoining projects, applicability of EIA notification dated 14.09.2006 and the ongoing court case.................................... .
In compliance to the decisions of the personal hearing dated 18.11.2024, the project proponent of the colony submitted the permission for discharge of the treated domestic effluent into MC sewer from Department of Punjab Water Supply & Sewerage Board, Barnala vide letter no. 223 dated 26.03.2021, which is reproduced as under: -..........................
“ਨਗਰ ਕੌਂਸਲ ਦਾ ਪੱਤਰ ਨੰਬਰ 660/ਵ ਮਿਤੀ 21.11.2017 ਜੋ ਕਿ ਨਿਮਨਹਸਤਾਖਰ ਨੂੰ ਸੰਬੋਧਿਤ ਹੈ ਮੁਤਾਬਿਕ ਆਪ ਦੇ ਰੋਇਲ ਪਾਸ ਗਰੁੱਪ ਹਾਉਸਿੰਗ ਪ੍ਰੋਜੈਕਟ ਹੰਡਿਆਇਆ ਰੋਡ (ਫਲੈਟਾਂ) ਦੇ ਸੀਵਰ ਨੂੰ ਮਹਿਕਮੇ ਦੇ ਮੇਨ ਸੀਵਰ ਨਾਲ ਜੋੜਨ ਦੀ ਮੰਨਜੂਰੀ ਇਸ ਸ਼ਰਤ ਤੇ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ ਕਿ ਫਲੈਟਾਂ ਦੇ ਏਰੀਏ ਤੋਂ ਇਲਾਵਾ ਪ੍ਰੋਜੈਕਟ ਦੇ ਪਿੱਛੇ ਲਗਦੀਆਂ ਕਲੋਨੀਆਂ ਨੂੰ ਇਸ ਨਾਲ ਨਾ ਜੋੜਿਆ ਜਾਵੇ ਸਿਰਫ ਫਲੈਟਾਂ ਦੇ ਏਰੀਏ (ਰੋਇਲ ਪਾਮ ਗਰੁੱਪ ਹਉਸਿੰਗ ਪ੍ਰੋਜੈਕਟ) ਦੇ ਸੀਵਰ ਨੂੰ ਹੀ ਮੇਨ ਸੀਵਰ ਨਾਲ ਜੋੜਨ ਦੀ ਇਜਾਜਤ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ ਅਤੇ ਮਹਿਕਮੇ ਦਾ ਇਹ ਮੇਨ ਸੀਵਰ ਸੀਵਰੇਜ ਟਰੀਟਮੈਂਟ ਪਲਾਂਟ (STP) ਨਾਲ ਜੋੜਿਆ ਹੋਇਆ ਹੈ ਅਤੇ ਆਪ ਨੂੰ ਇਹ ਵੀ ਲਿਖਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਫਲੈਂਟਾ ਦੇ ਮਾਲਕ ਆਪਣੇ ਫਲੈਟਾਂ ਦੇ ਹਾਊਸ ਕੁਨੈਕਸ਼ਨ ਵੱਖਰੇ ਤੌਰ ਤੇ ਮਹਿਕਮੇ ਦੀਆਂ ਸ਼ਰਤਾਂ ਮੁਤਾਬਿਕ ਪਾਸ ਕਰਵਾਉਣ ਦੇ ਪਾਬੰਦ ਹੋਣਗੇ ਅਤੇ ਬਿਲਾਂ ਦੇ ਬਣਦੇ ਚਾਰਜ ਭਰਨ ਦੇ ਪਾਬੰਦ ਹੋਣਗੇ।“.........................
As per the decision of the Competent Authority, the site of the project was visited by the undersigned on 17.12.2024 and it was observed as under: -
1. The project proponent has constructed 56 number flats (two blocks each with 28 flats). ..........................................
2. The project proponent has installed STP for treatment of domestic effluent. The STP was in operation during visit. The effluent samples were collected from the outlet of the STP during visit and as per the analysis report (pH-7.9, TSS- 11 mg/l, TDS- 864 m/l, COD-76 mg/l, BOD-14 mg/l & Oil & grease (mg/l)-BDL), all the parameters are within the limits prescribed by the Board. ...................................
3. The project proponent of project has submitted the permission from Department of Water Supply & Sewerage Board, Barnala regarding discharge of the treated domestic effluent into MC sewer. .........................
4. The project proponent has installed the energy meter as well as water meter at the final outlet of STP. The reading of the water meter installed at outlet of the STP was 450.5 KLD.......................
5. The project proponent has started to maintain the record of STP operation w.r.t. water meter and energy meter readings. ...................................
6. The project proponent has constructed 02 no. compost pits for treatment of the organic/wet waste. ..........................................
7. The project proponent has installed DG set of capacity 62.5 KVA with canopy & adequate stack height. .......................
8. The project proponent has submitted CA certificate having gross fixed assets of Rs. 452.62 Lakhs. Earlier, the project proponent had submitted project cost 1304 for construction of 98 flats. But the project proponent has constructed 56 no. flats only as such the value of project has been decreased. .............................
9. The project proponent has deposited the consent fees of Rs. 1,12,000 each vide UTR nos. 394666924 & 78179745 under the Water Act, 1974 & Air Act, 1981, which is adequate upto 30.09.2026 against the gross fixed assets of Rs. 452.62 lac after deducting the penalty fees as per the Board’s office order dated 29.10.2018............................
10. It is submitted that some local residents of Mahesh Nagar, District Barnala has filed the civil writ petition no. 8690 of 2021 in the Hon’ble Punjab & Haryana regarding to directing the official of concerned Government Departments (Respondents no. 1 to 7) to stop the private colonizers from merging their illegal colonies with the existing colony i.e. Mahesh Nagar. There is issue of 05 no. residential colonies namely M/s Mahesh Nagar, M/s Mahesh enclave, M/s Mahesh Avenue, M/s Mahesh Nagar (extension), M/s Royal Estate in the above said petition......................
The group housing project M/s Royal Palm exist in the common boundary wall of these projects. However, as per reply submitted by the Board in the CWP no. 8690 of 2021, the petitioners have not mentioned any issue regarding this project i.e M/s Royal Palm..................

12. As per approved layout plan submitted by the project proponent with the application the total covered area of floors i.e. 98 flats (first to Sixth) is 1,16,566.2 Sq. feet (i.e 10,830 Sq. meter) and covered area of Stilt floor is 19427.7 Sq. feet (i.e. 1805 Sq. meter). So, the total proposed built-up area for 98 flats (including stilt area) was 12,635 Sq. meter. But the project proponent has constructed 56 flats only. Hence, the built-up area of 56 flats is much less than 12,635 sq. meter. As such, the project is not covered under the EIA notification dated 14.09.2006.........................................
13. The project proponent is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981.....................
Keeping in view of the above, it is recommended that consents to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the project proponent for operation of 56 no. flats with validity upto 30.09.2026, subject to the following special conditions that: -.......................
1. The Consent to operate is being granted for 56 no. flats.......................
2. The project proponent will not construct any additional flat without obtaining prior consent to establish /NOC of the Board.......................................
3. The project proponent will make provision of dual plumbing and plantation in the project and utilize maximum treated effluent into dual plumbing and plantation and remaining treated effluent will be discharged into sewer............................................
4. The project proponent will operate the sewage treatment plant (STP) regularly and scientifically and shall maintain proper record of the effluent generated / treated....................
5. The project proponent will not use any fresh water in the green area/ plantation developed inside the project premises and make arrangements for use of treated effluent in green area............................
6. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016.............................
7. The project proponent shall maintain the vermicomposting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies................................
8. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic. The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. .....................................
9. This consent to operate is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required...............................
