File Note: Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 31.01.2025 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Hans Raj Auto Black, Jaspal Bangar Road, Near Jaspal Dharam Kanda, Mahdev Nagar, Industrial Area-C, Ludhiana. The Following were present: On behalf of Punjab Pollution Control Board Er. Pardeep Balu, Addl. Senior Environmental Engineer, Zonal Office-1, Ludhiana On behalf of the industry Sh. Ajay Kumar Bagga, Proprietor The Addl. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit engaged in Auto blacking of tractor parts, cycle parts on job basis. The industry was earlier given personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 30.10.2024, wherein, it was decided that the industry shall shift its unit to the designated industrial area as per the provisions of Master Plan, Ludhiana. And whereas, the industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. The consent application and report of RO has been perused and it has been observed as under:- 1. The industry has not submitted details of raw material to be used in application form. 2. The industry has been established without NOC of the Board. 3. The industry has submitted the copy of MSME certificate with date of commissioning is 01.08.2023 and made an agreement with an agreement with M/s JBR Technologies Ltd. Ludhiana for lifting of trade effluent @ 3000 Ltr/month in 16.08.2023. The industry has not submitted details w.r.t. water consumption and effluent generation from process from date of commissioning. 4. The industry has not intimated sources of air emission and columns are left blank in application form. 5. The industry has been established without NOC of the Board. The compliance to the NOC conditions is not signed by authorized signatory of the industry which are applicable for such type of industries. 6. The C.A. certificate is amended by over writing and the industry is required to submit authenticated copy of C.A. certificate. 7. The industry has earlier submitted MC Ludhiana letter no. 300 dated 20/09/2024 stating that the industry falls under Industrial Mix Zone and now submitted new letter issued to the applicant with same letter no. 300 dated 20-09-2024. The dispatch number is same which is contradictory. In view of the above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 31.01.2025. Sh. Ajay Kumar Bagga, Proprietor of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in Auto blacking of tractor parts, cycle parts on job basis. The industry is using the raw Materiel as electricity equipment / Diesel / cutting wood/ Cutting Oil mixture, Natural water mixture, sodium nitrate mixture, sulfuric acid mixture etc. The industry had submitted MSME certificate mentioning date of commissioning as 01/08/2023 as installed the tanks but work start 16/08/2023 onwards. The industry has installed the chimney for dispersion of process emissions. The industry has submitted certified CA authenticated document. The industry has same letter as clarify by ATP MCL, Ludhiana on mail dated Mon, 23 Dec 2024 mentioning that the site falls under Industrial Zone and previous letter mentioned the above same property under Industrial Mix Zone which was canceled due to the Clerical Mistake. So, the new (correct) letter was issued to the applicant with stamp that the site falls under industrial zone with same Letter no 300/DRG-C/D Dated 20-09-2024. After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:- 1. The industry shall get its trade effluent lifted to CETP operator regularly. 2. The industry shall maintain the record of water consumption and effluent lifted to CETP operator on daily basis. 3. The Environmental Engineer, Regional Office-2, Ludhiana shall verify submissions made by the industry during the hearing and submit further recommendations in the matter, within 15 days. Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
