File Note: Sir, it is submitted that the industry was issued show cause notice for refusal of varied consents to operate applied by the industry under the Water Act, 1974 and the Air Act, 1981 as well as notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 alongwith an opportunity of personal hearing before CEE (B) on 21.01.2025, wherein, the following decisions were taken and the point wise compliance is also mentioned as below: Sr. No. Decision Compliance 1 Environmental Engineer, Regional Office, Fatehgarh Sahib shall clearly comment upon the fact that as to whether operation of the industry in the existing premises is feasible as per the provisions of notified Master Plan of Mandi Gobindgarh, within 3 days. If yes, upto which date operation of the industry could be allowed at the existing site, so that the consent applications of the industry may be decided on merits. The industry has submitted the land use classification vide Memo no. 454 dated 31.05.2023 issued by DTP, Fatehgarh Sahib, vide which, the industry falls within the MC limit of Mandi Gobindgarh and in the Industrial Mixed Land Use Zone as per the notified Master Plan of Mandi Gobindgarh. Further, the Directorate of Town and Country Planning Punjab has amended the Unified Regulations of Master Plans vide notification dated 24.09.2021 and the amended conditions for Industries in Industrial Mixed Land Use Zone within the Municipal Limits is as under: (i) No new industrial units shall be allowed to be set up in the Industrial Mixed Zone within the municipal limits. (ii) All modernization/expansion within the existing industrial premises shall be permitted with no increase in pollution load on environment. (iii) All expansion beyond the limits of existing industrial premises shall only be permitted for Green category industries, and shall be subject to fulfilling of the following conditions: a. Use of Rice husk, Coal, wood and Pet coke as fuels shall not be permitted. b. Use of ZLD effluent treatment technology by the individual unit or treatment through CETP based on ZLD technology. c. Wherever specific siting guidelines are prescribed by State Govt./ PPCB, etc. for industries vis-ã-vis residential areas/ other establishments, the liability to adhere to these guidelines shall lie with the activity which comes later on vice-versa principles. d. Wherever green buffer zone is required as per the PPCB norms, the activity which will comes later shall be liable to adhere to the norms of reserving minimum green buffer as per requirement from their own land. The above said clauses does not clearly depict that as to whether an existing green-category industry within the MC limits is permissible in the Industrial Mixed Land Use Zone. As such, to decide the permissibility, it is recommended that a clarification may be sought from Department of Housing & Urban Planning as to whether the existing green category industries are permitted in the Industrial Mixed Land Use Zone or not. In the meantime, the application may be returned at this stage to avoid any confusion w.r.t. permissibility as the DTP, Fatehgarh Sahib has not mentioned as to whether the industry is permissible in this zone or not. 2 Environmental Engineer, Regional Office, Fatehgarh Sahib shall personally visit the industry to check the implementation of the recommendations made by NISST and what is the qualitative effect on the reduction of noise level being generated from the operations of the industry i.e. cutting of raw material, heating, rolling, end cutting, bundling, loading etc.. In accordance with the directives of the Competent Authority during yesterday's meeting, compliance of this point is being verified and shall be processed through a separate e-note. In view of the facts mentioned above, if approved, it is recommended that the Consent to Operate applied under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be returned at this stage, please.
