Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 24.02.2025 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 - M/s P.G.A. Industries, B-29-09157, Industrial Area-C, Dhandari Kalan, Ludhiana.

The Addl. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category drawing/acid pickling unit and the industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974.
The consent application of the industry and report of visiting officer has been pursued and following observations has been observed:-
1. The industry has submitted the copy of MSME certificate with date of commissioning is 01.08.1985 and made an agreement with an agreement with M/s JBR Technologies Ltd. Ludhiana for lifting of trade effluent @ 3000 Ltr/month in 02.01.2025. The industry has not submitted details w.r.t. water consumption and effluent generation from process from date of commissioning at new site.
2. The industry has made agreement with M/s JBR Technologies Ltd. Ludhiana for lifting of trade effluent @ 3000 Ltr/month in 02.01.2025 and it seems that the industry might be discharging untreated effluent generated from drawing/acid pickling process into sewer/ illegal manner from date of commissioning of the unit.
3. The industry has been established without NOC of the Board. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
The industry is not complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974. Thus, violating provisions of said Act.
In view of the above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 24.02.2025.
Sh. Amarjeet Singh, Representative of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in manufacturing of Cleaning of H.R. Sheet. They are operating unit in same name at St. no. 12, Dashmesh Nagar, Ludhiana in which they have obtained consents from PPCB with a validity upto 30.06.2028. Now, they have shifted their unit to new location at B-29-09157, Industrial Area-C, Dhandari Kalan, Ludhiana and agreement has been extended from 2000 Ltr to 3000 Ltr/month. Accordingly, they have registered under MSME with date of commencement as 01.08.1985. However, they have rented the premises from 01.12.2024 in which rent deed have been attached herewith. They have made agreement with the JBR technologies on 02.01.2025 and started operation of the unit thereafter. Record regarding water consumption vis-à-vis effluent generation is enclosed. All the effluent is being discharged to JBR technologies and no untreated effluent was discharged into sewer/any other mode. They have applied for obtaining consent to operate under Water Act, 1974 and NOC fee of the same has been submitted in the application. He further requested to grant consent to operate under the Water Act; 1974.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get its trade effluent lifted to CETP Operator regularly and shall maintain record regarding water consumption, effluent lifted to CETP Operator.
2. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be granted to the industry as per adequacy of deposited consent fee.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
