Sub:- Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 :- M/s Maan Bricks (Formerly Known as Nav Durga Gram Udyog Samiti BKO), Vill. Saloudi, Tehsil Samrala, Ludhiana.
It is submitted that the PP has applied for Consent to Establish (NOC) for manufacturing of bricks and tiles @ 33333 nos/day using sand/clay @ 99 MTD as raw material on 21.02.2025. The PP proposes to use coal/wood/pallets @ 5 TPD as fuel. It has submitted the following documents with its application: -
1. Location Plan.
2. Partnership deed.
3. CA certificate.
4. Copy of Jamabandi
5. Authority letter
6. Feasibility report to adopt Zig-Zag technology alongwith completion certificate.
7. Special power of attorney
8. NOC fee of Rs.3400/- (Rs. 2900/- as CTE fee + Rs. 500/- as form fee) vide UTR no. AXSK250240010591 dated 24.01.2025.
The PP was requested to submit the documents within 02 days through clarification dated 24.02.2025 as under:-
1. The brick kiln has not submitted the certificate from Competent Authority i.e. Deputy Commissioner, Ludhiana/SDM, Samrala regarding siting guidelines incompliance to the Board’s notification no. Admn/A-2/F No. 178/98/3 dated 02.09.1998, MoEF&CC notification dated 22.02.2022 and Govt. notification dated 28.05.2019(copies attached).
2. It has also not submitted the certificate of DTP, Ludhiana regarding classification of area of the proposed site as per approved Master Plan of Samrala and the distances from the requisite points as mentioned in the above said notifications.
The PP has not submitted the above said documents, but it has submitted its reply on 26.02.2025 which is reproduced as under:-
“It is informed you that earlier, the said brick kiln given on lease (copy attached) to Sh. Parveen Kumar, (Proprietor) and operating under the name of M/s Nav durga gram Udyog Samiti BKO had obtained renewal of consent to operate under the Air Act, 1981, valid upto 30/9/2020. Afterwards, the said brick kiln has closed its operations at its own. Now, Lessor i.e. Maan Bricks wants to operate the said existing brick kiln and applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 after converting the high draft zig zag technology. But you have rejected my applications of CTOs and directed to apply NOC a fresh and moreover clarification has been raised to submit DTP and SDM Report. I number of times requested you inform requested letter and reply against raised your objection (copy of the letter attached with the application). But your department may application refused again and again, my brick kiln is exiting brick kiln not a new brick kiln. In view of above, we humbly requested to please grant us consent to operate applied under the Water Act, 1974 and the Air Act, 1981, please.”
It is pertinent to mention here that as per OCMMS record previously a brick kiln namely M/s Nav Durga Gram Udyog Samiti BKO, Village Saloudi, Tehsil Samrala, Ludhiana was in operation and it has obtained the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH2/2017/5637881 dated 01.06.2017 which was valid upto 30.09.2020.
The said brick kiln was earlier, visited by officers of the Bord on 26.05.2021 and it was observed that the brick kiln was not in operation and the physical appearance of the BKO shows that it was lying closed since long. The BKO has not covered its existing (Natural Draft technology) to induced draft technology with zig-zag setting and also not deposited environmental compensation on the basis of polluter pays principle to the Punjab Pollution Control Board with effect from 01.02.2019. Hence, the brick kiln (i.e. M/s Nav Durga Gram Udyog Samiti BKO, Village Saloudi, Tehsil Samrala, Ludhiana) was issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 were issued vide Board’s letter no. 3617-18 dated 19.08.2021, as the brick kiln has neither submitted MoU/agreement/feasibility report with any of the technical providers (PSCST/CBRI) for conversion to induced draft technology with zig-zag setting nor deposited the EC to this office and District Food & Supply Controller, Ludhiana was directed vide Board’s letter no. 3613-15 dated 19.05.2021 as under:-
“That the authorities concerned shall suspend the license issued to the subject cited brick kiln by DFSC, Ludhiana and not to renew the same without further directions from the Board.”
The PP has not submitted the certificate from Competent Authority i.e. Deputy Commissioner, Ludhiana/SDM, Samrala regarding siting guidelines incompliance to the Board’s notification no. Admn/A-2/F No. 178/98/3 dated 02.09.1998, MoEF&CC notification dated 22.02.2022 and Govt. notification dated 28.05.2019 and the certificate of DTP, Ludhiana regarding classification of area of the proposed site as per approved Master Plan of Samrala and the distances from the requisite points as mentioned in the above said notifications.
If approved, show cause notice for refusal of Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be issued with an opportunity of personal hearing before EE (RO-2), Ludhiana.(Soft copy attached)
