It is submitted that the project proponent has submitted compliance of decisions of personal hearing and the same is given below:
Further, the project proponent has attached copy of notarized affidavit vide which, M/s Town Bell India Craft Pvt. Ltd. has agreed to take/ utilize treated effluent from the project proponent M/s Wisteria Housing Pvt. Ltd. (Project: Nav Emporio & VIP Grand Walk) for construction purpose in their projects namely Amayra Trillum and Amayra Trillium Street for first two years. Further, the project proponent has also attached the notarized affidavit / undertaking to supply the treated wastewater to M/s Town Bell India Craft Pvt. Ltd. according to the norms of PPCB.
In view of the above, the proposal of the project proponent to utilize the treated wastewater into construction purposes may be considered in light of the NOC granted by Head Office to the project namely Aura Gazania Commercial, Zirakpur, therefore, it is recommended that:
1. The project proponent shall apply for consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 before allowing occupancy in the project.
2. The project proponent shall install STP of adequate capacity for the treatment of wastewater generated from the project.
3. The project proponent shall ensure a proper GPS enabled facility for the transportation of treated wastewater to the projects namely “Amayra Trillum” and “Amayra Trillum Street”, failing which, the project proponent will be bound to provide alternate arrangements for disposal of treated effluent.
4. The project proponent shall maintain a proper daily record regarding lifting of treated wastewater.
5. The project proponent shall ensure that there is no illegal mode of disposal of treated wastewater by it, failing which, action will be initiated against the project proponent as per Environmental laws.
6. The Board shall not be responsible for any financial loses, in case the project proponent fails in obtaining land for which it has obtained letter of consent for establishing its commercial project.
7. The project proponent shall apply for consent to operate from the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 before commissioning of the project.
8. The project proponent shall provide mechanical composter of adequate capacity for the treatment of wet biodegradable waste.
9. The promoter shall lay down pucca distribution network / pipe grid from the STPs to the various green lawns / stretches / dual plumbing system for flushing purposes / for construction activities and shall not allow it to stagnate anywhere inside or outside the project.
10. The promoter shall irrigate the green belt / area to be developed within the project area with the treated wastewater only and no fresh water will be used for this purpose as well as for construction activities within the project.
11. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
12. The project proponent shall obtain necessary permission from PWRDA for abstraction of ground water.
13. If the project proponent violates any of the above 6 conditions, legal action under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated against the project proponent without affording any opportunity.
14. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
15. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
16. The promoter company shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
17. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing on-site facility to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
18. The promoter company shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
19. The promoter company shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
20. The promoter company shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form.
21. The promoter company shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
22. The promoter company shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
23. The promoter company shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
24. The promoter company shall provide mask to every worker working on the construction site and involved in loading / unloading and carries of construction material and construction debris.
25. The promoter company shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
26. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
27. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
