It is submitted that earlier the industry was granted Consent to Operate Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2022/20418655 dated 21.11.2022 valid upto 30.09.2027 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/20418607 dated 21.11.2022 valid upto 30.09.2027 for Screening & washing of aggregates @ 11000 CFT/day as a raw material subject to certain terms and conditions mentioned therein.
The site of the unit was surprisingly visited by the AEE of this office on 18.05.2023. During visit, it was observed as under:

Accordingly, the industry was issued show cause notice for revocation of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and cancellation of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing on 17.02.2025 before the Environmental Engineer of the Board vide this office letter no. 771 dated 06.02.2025, wherein, it was decided as under:
1. The consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/ cancelled.
2. Action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be recommended to the Competent Authority for the closure of industry.
In compliance to decision no. 1, the consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 was revoked vide letter no. 963 dated 24.02.2025 and the consent to operate under the Air (Prevention and Control of Pollution) Act, 1981 was cancelled vide letter no. 961 dated 24.02.2025. The above report has been submitted to the Competent Authority of the through E-noting no. 28153007 with the recommendations that directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the industry for its closure.
It is pertinent to mention here that a CWP No. 12273 of 2023 titled as Ram Singh & other Vs State of Punjab & other are pending before the Hon’ble Punjab & Haryana High Court, wherein, the action taken by the Board against the violating units has been given in the reply on behalf of the Board after obtaining approval from the Competent Authority of the Board.
Now, the industry has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Screening & washing of aggregates @ 11000 CFT/day alongwith requisite documents.
The industry has deposited Rs. 11600/- vide R. No. 33121029 dated 27.02.2025 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 12100/- vide R. No. 21984140 dated 27.02.2025 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the industry is adequate upto 30.09.2032 against the total cost of the industry Rs. 38.75 lacs as on 31.03.2024 as per CA certificate submitted by the industry.
The industry has submitted the permission obtain from Mining Department for operation of Crusher/Screening Plant namely Mavi Screening Plant of capacity of above 5000 in Khasra No. 63//26 Gram Panchayat Mianpur Changer P.O....(post office) Tehsil Kharar District Mohali vide application no. SC-60176 dated 06.02.2025, which is valid upto 05.02.2026. Further, this office has sent the revoked/ cancelled copies of consent to Department of Mining for necessary action at their end through e-mail dated 12.03.2025.
In view of the above, it is recommended that the consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be decided in light of the recommendations sent and decisions of the Competent Authority w.r.t. e-noting no. 28153007.
