It is submitted that the project proponent was issued show cause notice for refusal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, alongwith an opportunity of personal hearing before the Member Secretary of the Board on 17.01.2025, wherein, it has been decided as under:
1) Environmental Engineer, Regional Office, SAS Nagar shall visit the project site, carry out the monitoring of the STP installed and compliance of the conditions of the environment clearance and submit the report within 15 days.
2) Environmental Engineer, Regional Office, SAS Nagar shall get the action concluded against M/s RSA Dynamic (Service station) and thereafter submit recommendations to decide the application of the project proponent.
3) Further action in the matter will be taken on the receipt of report from Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar.
Accordingly, the site of the project was visited by officer of this office and during visit, it was observed as under:
1. The promoter company has constructed the building having configuration of double basement+ ground + 11 floors consisting for space for offices & studios.
2. The construction work of all the floors have been completed. At present 15-20 offices is operational in the commercial building.
3. The promoter company is carrying out finishing work of rooms meant for hotel however; at present no hotel in operation.
4. The promoter company has installed STP based on MBBR technology and same was in operation During visit, effluent sampling was carried out and the analysis results as obtained from Head office Lab, Patiala dated 28.02.2025 is tabulated as under:

From above, it is clear that the project proponent is complying with the prescribed standards.
5. The promoter company has provided motors for utilizing the treated wastewater for flushing system. However, at present generation of effluent is very less the treated effluent mainly use for onto plantation and rest into sewer.
6. The project proponent has installed 02 no. DG sets of capacity 240 KVA and 32 KVA, which is provided with canopies and adequate stack height.
From above, it is clear that the project proponent has complied with most of the observations made during the previous visit. However, the project proponent is still required to comply with all the conditions of the last granted ‘Consent to Operate’ and Environmental Clearance.
Details of action against RSA dynamics:
the project proponent was issued show cause notice, alongwith an opportunity of personal hearing before SEE of the Board on 13.01.2025, wherein, it was decided as under:
1. The Consent to operate granted to the project proponent under the provisions of the Water Act, 1974 and Air Act, 1981 shall be revoked/ cancelled. Further, the authorization granted under the Hazardous & Other Wastes (Management & Trans boundary Movement) Rules, 2016 shall be cancelled being the project proponent failed to comply with the conditions mentioned therein.
2. Environmental Engineer, Regional Office, SAS Nagar shall encash the bank guarantee submitted by the industry amounting to Rs. 1 lac (One Lakh) immediately.
3. Further action under u/s 33-A/ 31-A of the Water Act, 1974 and Air Act, 1981 shall be initiated against the industry for its closure. 4) Further action will be taken after receipt of report from the Environmental Engineer, PPCB, Regional Office, SAS Nagar.
The proceedings of the hearing dated 13.01.2025 taken by Senior Environmental Engineer of the Board have been conveyed to the industry vide Board's letter no. 5478 dated 23.01.2025.
The consents to operate obtained by the industry under the provisions of the Water Act, 1974 and the Air Act, 1981 have been revoked/cancelled vide Board's letter nos, 5536 dated 24.01.2025 and 5538 dated 24.01.2025 respectively.
The authorization obtained by the industry under the Hazardous & other Waste Management Rules, 2016 has been cancelled vide Board's letter no. 5547 dated 24.01.2025.
Thereafter, industry was issued show cause notice for issued direction u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 vide letter no. 6279 dated 27.02.2025, alongwith an opportunity of the personal hearing before the Worthy Chief Environmental Engineer on 21.02.2025, it was decided as under:
1. That the industry shall take all necessary steps to close down its operations.
2. That the industry shall stop forthwith discharging any effluent / emissions from its premises or through any mode.
3. That the industry will immediately stop its activities and will not restart the same unless all necessary water and air pollution control measures are taken and obtains valid consents of the Board.
4. That the Punjab State Power Corporation Ltd. authorities shall be directed to disconnect the supply of electricity available to the industry.
5. That DG sets (if any) installed by the industry shall be sealed.
Accordingly, the industry was visited by the officer of this office on 05.03.2025, during visit, it was observed as under:
1. During visit, DG set of capacity 125 KVA has been sealed in the presence of the representative of the project proponent.
2. Further, washing area was operational and the representative informed that around 7-8 vehicles has been washed today. As such, main electric control panel of washing area is also sealed to rule out possibility of operation of washing zone.
3. Picture were clicked during the visit.
From above, it is clear that the action against RSA Dynamics has been concluded, as per decision no. 2 of the hearing held on 17.01.2025.
In view of above, if may approved, the project proponent may be granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 31.03.2026, subject to suitable conditions and following additional conditions:
1. The project proponent shall immediately start using treated wastewater for flushing purpose inside its premises and shall use only treated wastewater for the said purpose.
2. The project proponent shall not use freshwater for flushing purpose inside its premises.
3. The project proponent shall install separate EMF meters at the lines containing treated wastewater for flushing purpose, for plantation purpose and for MC sewer line, within 07 days. The project proponent shall maintain proper daily records of these EMF meters, at all times.
4. The project proponent shall install mechanical composter at the site for composting of biodegradable waste being generated from the project.
5. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water.
6. The project proponent shall comply with the conditions of the Environmental Clearance granted under the EIA notification dated 2006, at all times.
7. The promoter shall develop its residential complex as well as construct flats strictly in accordance with the layout / building plans approved by the Competent Authority. In case there is any change in the building plans, the project proponent shall be bound to obtain revised ‘consent to establish’ (NOC) from PPCB.
8. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
9. The adequacy/ efficacy of the pollution control arrangements and disposal scheme shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
10. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
11. The Consents is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
