The industry had obtained water/air consents dated 25.07.2023 both upto 31.12.2026 for manufacturing of Compostable Bags, Sheets and Rolls @ 7000 Kgs/Day, Plastic Rolls (Multilayered Cross Laminated Sheets and Rolls) @ 5000 Kgs/Day using PBAT (Poly Butyl Adipic Terephthalate) and Starch @ 4900 Kgs/Day, PLA @ 1400 Kgs/Day, Calcium Carbonate @ 700 Kgs/Day and Plastic Granules @ 5250 Kgs/Day as Raw Material under Small Scale/Green category unit.
A complaint was received against the industry for manufacturing of Plastic carry bags. Hence, the industry was issued show cause notice for violation of the provisions of the Punjab Plastic Carry Bags (Manufacture, Usage aned Disposal) Control (Amendment) Act, 2016 and the provisions of the Plastic Waste Management Rules, 2016 with an opportunity of personal hearing before Chairman of the Board on 18.11.2024, wherein it was decided as under:-
1. That the industry shall deposit Environmental Compensation of Rs. 50,000/- with Regional Office-II, Ludhiana within 07 days under intimation to this office.
2. The industry shall not manufacture Plastic Carry Bags/ Biodegradable /Compostable Plastic Carry bags in the state of Punjab.
3. Regional Office-II, Ludhiana shall revoke the consents to operate obtained by the industry under the Water Act, 1974 and the Air Act, 1981 for manufacturing of compostable Bags, sheets and rolls @ 7000 Kgs/Day, Plastic Rolls (Multilayered cross laminated sheets and rolls) @ 5000 Kgs/Day by using PBAT @ 4900 Kgs/Day, PLA @ 1400 Kgs/Day, Calcium Carbonate @ 700 Kgs/Day and Plastic Granules @ 5250 Kgs/Day, immediately.
4. The industry shall submit the fresh application for obtaining the consents under the Water Act, 1974 and Air Act, 1981 for manufacturing of products other than the compostable Plastic Carry Bags within 7 days.
5. Regional Office-II, Ludhiana shall make a surprise visit to the industry to verify as to whether industry is manufacturing plastic carry bags or not, within one month and send a report to this office.
The compliance of the above decisions of personal hearing is as under:-
1. The industry has deposited Rs. 50,000/- vide Receipt No.86/5567 Dated 27.01.2025 as Environmental Compensation in this office.
2. As observed during visits dated 17.01.2025, 05.02.2025 and 20.03.2025 the industry was not found manufacturing Plastic Carry Bags/ Biodegradable /Compostable Plastic Carry bags in its premises.
3. The water/air consents obtained by the industry for manufacturing of compostable Bags, sheets and rolls @ 7000 Kgs/Day, Plastic Rolls (Multilayered cross laminated sheets and rolls) @ 5000 Kgs/Day by using PBAT @ 4900 Kgs/Day, PLA @ 1400 Kgs/Day, Calcium Carbonate @ 700 Kgs/Day and Plastic Granules @ 5250 Kgs/Day have been revoked Dt 10.12.2024.
4. Now, the industry has applied for consent to operate under the Water Act, 1974 and the Air Act, 1981 on 13.03.2025 which have been processed with this compliance.
5. The industry was visited surprisingly on 17.01.2025, 05.02.2025 and 20.03.2025 the industry was not found manufacturing Plastic Carry Bags/ Biodegradable /Compostable Plastic Carry bags in its premises.
The industry has applied for consent to operate under the Water Act, 1974 and Air Act, 1981 for manufacturing of (1) Compostable Industrial Packing Bags, Sheets and Rolls @ 7000 Kg/Day (2) Multilayered Cross Laminated Tarpaulin Covers, Sheets & Bags @ 5000 Kgs/Day (3) Paper Sheets, Paper Rolls @ 1000 Kgs/Day (4) Plastic Reprocess Granules @ 1200 Kgs/Day using (1) PBAT(Poly Butyl Adipic Terephthalate) and Starch 4900 Kgs/day (2) PLA 1400 Kgs/day (3) Calcium Carbonate @ 700 Kgs/Day (4) Plastic Granules @ 5250 Kgs/Day (5) Paper @ 500 Kgs/Day and (6) Plastic Waste for re-processing @ 1000 Kgs/Day as Raw Material.
To verify the facts at site, the industry was visited by RO on 20.03.2025 and it was reported as under: - 1. During visit industry was in operation. 2. The industry has installed 04 extruder for manufacturing of sheets, 01 extruder manufacturing for plastic granules, 01 agro machine, 01 printing machine and other allied machinery. 3. There is no generation to trade effluent. Domestic effluent is discharged onto land for plantation after treating in septic tank and cooling water is being re-circulated. 4. It has installed a D.G. Set of capacity 350 KVA with canopy and adequate stack height.
In view of above, it is recommended that consent to operate under the Air Act, 1981 may be granted to the industry up to 30.09.2029 with usual conditions and special condition that:- 1. The industry shall not manufacture any Plastic Carry Bags of any material in its premises. 2. The industry shall always comply with the provisions of the Punjab Plastic Carry Bags (Manufacture, Usage and Disposal) Control (Amendment) Act, 2016. 3. The industry always comply with the provisions of the Plastic Waste Management Rules, 2016. 4. The industry shall make agreement with authorized agency for lifting of hazardous waste, if it re-starts the printing process.
