Varied Consents Refused:
The industry was issued show cause notice for refusal of consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 alongwith an opportunity of personal hearing before the CEE (B) of the Board on 10.02.2025, wherein, the following decisions were taken and the point wise compliance is as under:

1 The industry shall submit a comprehensive bank guarantee amounting to Rs. 10.0 lakh within 7 days, as an assurance to comply with the environmental laws at Regional Office, Fatehgarh Sahib. The industry has submitted a bank guarantee amounting to Rs. 10.0 lakh vide no. 05331ILG000325 dated 10.03.2025, which is valid upto 09.03.2026.
2 Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry immediately to verify the contentions of the industry and shall process the applications to be submitted report/ recommendations to decide the consent applications. The industry was visited by the undersigned on 20.02.2025 and report was sent to the Competent Authority.
3 Further action in the matter shall be taken after receipt of the report from Regional Office, Fatehgarh Sahib. Accordingly, the consent to operate applications applied by the industry under the Water Act, 1974 vide no. CTOW/Varied/FGS/2025/27605357 and under the Air Act, 1981 vide no. CTOA/Varied/FGS/2025/27605302 dated 05.03.2025 were refused.

Provisional Certificate:
The industry has submitted the provisional certificate issued by PSCST, Chandigarh vide no. PSCST/TFD/307 dated 23.12.2024 regarding installation of APCD for control of primary emissions with the Induction Furnace of capacity 10 TPH; however, it has not submitted the adequacy certificate of the same.
Applicability of EIA notification dated 14/9/2006:
The production capacity is more than 30,000 TPA, therefore, the industry requires clearance under EIA notification dated 14/09/2006. However, as per the Ministry of Environment, Forest and Climate Change (MoEFF&CC) notification dated 07/06/2024, the industries involving in melting of non-toxic metals having production capacity less than 60,000 TPA are exempt from obtaining clearance under EIA notification dated 14/9/2006. In this case, the annual production of the industry is 49,000 TPA (140 TPD * 350 working days), which is less than 60,000 TPA. As such, the industry does not fall in the ambient of EIA notification dated 14/09/2006.
Secondary Emission:
The industry had proposed to install the secondary system to control the secondary emissions generated from the process at the time of obtaining NOC expansion; however, it has not installed the same. In this regard, the industry has submitted the PERT chart w.r.t. preparation of feasibility report as well as installation of system to control the secondary emissions generated from the process.
PWRDA Permission:
The industry has applied for obtaining permission for ground water abstraction @ 1230 KL/Month, which is under process.
Visit:
The industry was visited by the undersigned on 02.04.2025 and Sh. Chirag Singla, Partner was contacted. During visit, it was observed as under:
⦁ The industry was in operation.
⦁ The industry has installed induction furnace of capacity 10 TPH.
⦁ The industry has installed pulsejet bag filter along-with side hood technology as APCD to control the air emissions from the furnace as per design evolved by PSCST, Chandigarh.
⦁ The suction hood suction was functioning properly in capturing and containing the emissions.
⦁ The industry has now maintained the record of energy meter installed on the APCD.
⦁ As per the record, the stack emission sampling of Induction Furnace of capacity 7 TPH was carried out by the officers of the Board on 07.11.2024 and as per the analysis results, the concentration of SPM was 52 mg/Nm3, which is within the permissible limits as prescribed by the Board.
⦁ The industry has also installed Continuous Concast Plant (CCM) as well as rolling mill after its induction furnace.
⦁ The industry is complying with directions/ suggestions of PSCST, Chandigarh given in SOPs for operation of APCD and is maintaining the required data.
⦁ The industry has now installed online continuous emission monitoring system with its stack in compliance to the previous consent condition. However, the same has not been linked with the server of the Board.
⦁ The industry has now stabilized the movement area.
⦁ The industry has installed one no. D.G. set of capacity 365 KVA, which is equipped with canopy and stack has also been provided on the same.
⦁ The industry has installed 01 no. submersible pump for abstraction of fresh water and it has now maintained the record of the same.
⦁ No water is used in the process, so no trade effluent is generated and the water used in cooling tower is being recirculated.
⦁ The industry has now developed the plantation area alongside the boundary walls and the domestic effluent is being discharged onto planation after treated through septic tanks.
⦁ The industry has installed the Environmental data board at the entrance of the gate and it has also maintained the same.
⦁ The industry has now maintained the record of hazardous waste generated.
From above, it is clear that the industry has removed the observations as observed during the previous visit and is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of the facts mentioned above, if approved, it is recommended as under the varied consent to operate under provisions of the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Flats/ Angles/ Rounds/ Squares/ Billets/ Bars etc. @ 140 MTD may be granted upto 30.09.2027 subject to the general conditions and additional conditions as under:
⦁ This consent is granted for manufacturing of Flats/ Angles/ Rounds/ Squares/ Billets/ Bars etc. @ 140 MTD by using Iron & Steel Scrap/Ferro Alloys @ 151 MTD as raw material.
⦁ The industry shall submit the permission for ground water abstraction from Punjab Water Regulation and Development Authority (PWRDA) in this office, as & when received.
⦁ The industry shall not generate and discharge any kind of trade effluent and shall not start wet process in its premises without prior written permission of the Board.
⦁ The industry shall only discharge only domestic effluent onto land for plantation within its premises, after passing through septic tank.
⦁ The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
⦁ The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
⦁ The industry shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
⦁ The varied consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 applied by the industry for manufacturing of Flats/ Angles/ Rounds/ Squares/ Billets/ Bars etc. @ 140 MTD may be granted for short term period i.e. upto 30.09.2026 as the industry has not installed the secondary system subject to the general conditions and additional conditions as under:
⦁ This consent is granted for manufacturing of Flats/ Angles/ Rounds/ Squares/ Billets/ Bars etc. @ 140 MTD by using Iron & Steel Scrap/Ferro Alloys @ 151 MTD as raw material.
⦁ The industry shall submit the adequacy certificate of the APCD installed with Induction Furnace from PSCST, Chandigarh within 01 month.
⦁ The industry shall submit the feasibility report for installation of system to control secondary emissions from induction furnaces within 1 month and shall install the system to control the secondary emissions within 03 months after obtaining the feasibility report of secondary emission containing system from the PSCST, Chandigarh.
⦁ The industry shall link the online continuous emission monitoring system with the server of the Board within 15 days.
⦁ The industry shall carry out the stack emission sampling from Board’s lab within 01 month.
⦁ The industry will operate & maintain its air pollution control device (APCD), regularly and efficiently, so as to achieve the stack emission standards, consistently as prescribed by the Board/ MoEF&CC as amended from time to time.
⦁ The industry shall comply with the SOPs framed by the PSCST, Chandigarh to operate APCD at all the time.
⦁ The industry shall use good quality scrap with proper size as raw material at all the times.
⦁ The industry shall ensure that no black smoke should be emitted from the stack of the industry at any time.
⦁ The industry shall reutilize its cooling tower blow down and water softener reject for sprinkling purposes and other non-core activities, only.
⦁ The industry shall obtain NOC of the Board, if it changes any of its product or raw material or enhances its production capacity in future.
⦁ The industry shall ensure that there is no public nuisance in the area, due to activities of the industry.
⦁ The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
⦁ The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
⦁ The industry shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
