M/s Kissan Colonizers Pvt. Ltd was granted consent to establish (NOC) from pollution angle vide letter no. ZO-II/SGR/2008/NOC/165 dated 25.02.2008 expired on 24.02.2009 for setting up a residential colony namely 'Ram Rajya Enclave' in an area of 9.78 acres (96 residential plots & 24 commercial plots) in the revenue estate of Thikriwala Road, Sanghera, District Barnala, with certain conditions mentioned therein………………………
Thereafter, the PP has neither obtained extension in the validity of consent to establish nor applied for obtaining CTOs. A complaint was received in Regional Office, Sangrur alleging that the colonies of Barnala city causing water pollution in the area. To verify the contents of the complaint, the site of the colony was visited by officer of the Board on 09.06.2023 and it was observed as under:………………………..
1. The residential colony is located at Thikriwal Road, Barnala………………….
2. The colony has been established by the colonizer namely M/s Kissan Colonizer and has established the project in the name of “Ram Rajya Enclave”, “Ram Raj Enclave”, “Ram Rajya Enclave Ext-1” and “Ram Rajya Enclave Ext.-II”……………….
3. The wastewater generated from the houses is being discharged into internal sewer of the colony and the same has been connected with STP installed by the project proponent in the project namely Ram Rajya Enclave. However, the STP was found in defunct condition and untreated wastewater was being discharged directly into MC sewer. …………………..
4. The representative of the colony has informed that the Solid Waste generated from the colony is being dumped into dump site of MC Barnala without any segregation………………..
The projects were not complying with the provisions of Water Act, 1974. Accordingly, the project proponent was afforded opportunity of personal hearing before the Hon’ble Chairman of the Board on 04.10.2023 which was attended by Managing Director of the projects. After hearing, the Hon’ble Chairman of the Board decided as under: …………………..
1. The colonizer shall immediately stop any further construction activities at the sites of project namely “Ram Rajya Enclave”, “Ram Raj Enclave”, “Ram Rajya Enclave Ext-1” and “Ram Rajya Enclave Ext.-II”. ………………..
2. The PSPCL authorities be directed to not to release any new connection in the said colonies/ locations……………….
3. The Tehsildar, Barnala be directed to not to execute/ register any new sale or purchase deed in the said colonies/ locations. ………………
4. The Deptt. of Housing & Urban Development, Punjab be directed to cancel the license issued to the Developer/ Promoter. …………………
In compliance to hearing decisions, directions vide letter no. 3942 dated 30.10.2023 were issued to the Tehsildar, Barnala regarding not to execute/ register any new sale or purchase deed in the said colonies/ locations. Also, PSPCL authorities were directed vide letter no. 3945-46 dated 30.10.2023 to not to release any new connection in the said colonies/ locations……………….
The project proponent failed to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 as well as the decisions of personal hearing…………………..
Accordingly, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 was issued to the project proponent with an opportunity of personal hearing before the Hon’ble Chairman of the Board on 20.08.2024. After hearing the Hon’ble Chairman of the Board decided as under: - ……………………..
1. The project proponents shall submit an Environmental Compensation amounting to Rs. 5.0 lakh on best assessment judgement basis for their failure to comply with the Environmental Laws, within 7 days to the office of Environmental Engineer, Regional Office, Sangrur……………………..
2. The project proponents shall maintain & operate the STP of capacity 70 KLD installed in the project namely Ram Rajya Enclave, within 15 days and shall also made arrangements for disposal of treated wastewater………………
3. The project proponents shall apply for consents to operate under the Water Act, 1974 and Air Act, 1981 for its projects namely Ram Raj Enclave and Ram Rajya Enclave (Extension-I) within one month…………………………
4. The project proponent shall install STP of adequate capacity to treat the wastewater, which is being generated from other projects, within 2 months and thereafter submit the completion certificate to the Board. Also, the project proponents shall apply for consents to operate under the Water Act, 1974 and Air Act, 1981 for these projects namely Ram Rajya Enclave and Ram Rajya Enclave (Extension-II) within 15 days after installation of STP of adequate capacity…………………………
5. The project proponent shall make in-house arrangements for the management and handling of wet waste being generated from the premises of colonies within one month and thereafter submit the compliance to the Board within 7 days. …………………..
6. The project proponents shall submit a bank guarantee amounting to Rs. 10 lakh, as an assurance to comply with the above decisions, within 7 days. ………………………….
7. Environmental Engineer, Regional Office, Sangrur shall visit the site of the colonies after stipulated time period to verify the compliances made by the project proponent and process the consent applications of projects on merits. If approved, the proceedings may be conveyed to the project proponent as well as Regional Office for ensuring compliance…………………………..
It is submitted that the project proponents have developed 04 no. colonies in the one premises. The detail of these are as under:………………

Now, the Project Proponents has applied for obtaining Consents to operate under Water Act, 1974 & Air Act, 1981 for all these 04 no. projects, which are being processed, separately……………..
M/s Kissan Enclave (Regd.) has applied for obtaining Consents to operate under Water Act, 1974 & Air Act, 1981 for project ‘Ram Raj Enclave” from pollution angle for total land area 9.86 acres for operation of Residential Plots @ 92 Nos. and SCO's 19 nos. for discharge of treated domestic effluent @ 147.39 KLD (11.35 KLD into green area/parks and remaining 136.04 KLD into MC sewer, detail of the case is as under:-………………..
In compliance to hearing decisions dated 20.08.2024, the project proponent has deposited Environmental Compensation amounting to Rs. 5.0 lacs in the Board vide R. no. 01/5493 dated 03.02.2025 and Bank Guarantee vide no. 04190100000073 dated 25.11.2024 amounting to Rs. 10 lacs, which is valid upto 25.11.2025. …………………………..
• The Project Proponent has submitted copy of letter of approval to develop a colony vide no. DTP Sangrur/433 dated 20.03.2006 issued by competent authority -cum- District Town Planner, Sangrur for total site 9.86 acers…………………………
• The Project Proponent has submitted copy of CA Certificate, showing the value of fixed asset is Rs. 199.10 lacs. Accordingly, the project proponent has deposited fee for each of Rs. 1,43,600.00/- vide UTR / Ref. No. AXSK250440008430 dated 13.02.2025 & Rs. 1,43,600.00/- vide UTR / Ref. No. AXSK250440007116 dated 13.02.2025 under water Act, 1974 and Air Act, 1981, which is adequate for a period upto 30.09.2026……………………………….
• The Project Proponent has submitted copy of approved building plan duly signed by the Competent Authority cum District Town Planner, Sangrur vide no. RRE/RSB/04 dated 06.12.2005………………………
• The project proponent has submitted a copy of letter no. 912/B dated 28.02.2025 issued by Executive Officer, Municipal Council, Barnala regarding detail of built-up area of the project. As per which the total built-up area of the project is 46930.24 sq. yard (39239.65 sq. mtr.) including residential & commercial. As the total area is less than 50 hectare and built-up area is less than 1,50,000 sq meter, hence project does not cover in the EIA notification. ……………………………….
• The project proponent has installed common STP for treatment of effluent generated from these 04 no. colonies. The project proponent has upgraded its STP and submitted copy feasibility report of common STP of capacity 250 KLD installed for the treatment of domestic effluent generated from these colonies……………………………….
• The Project Proponent has submitted copy of letter issued by Sub Divisional Engineer, Punjab Water Supply and Sewerage, Sub Division, Barnala vide letter no. 80 dated 09.02.2021 to Sh. Jasveer Singh, project proponent regarding projects namely “Ram Rajya Enclave”, “Ram Raj Enclave”, “Ram Rajya Enclave Ext-1” and “Ram Rajya Enclave Ext.-II”. The site was visited by the officer of this office on 01.04.2025 and observed as under: -
1. The site of the proposed project is located at Thikriwala Road & Sanghera By-pass Road, Barnala within MC limit. …………………………………
2. At site, there are 4 projects namely M/s Ram Rajya Enclave, M/s Ram Raj Enclave, M/s Ram Rajya Enclave Extension I and M/s Ram Rajya Enclave Extension II. There is no boundary or any kind of bifurcation between these projects. ………………………………
3. In Ram Rajya Enclave there are total 92 plots and 19 no. commercial plots and out of which about 35 no. of the houses are constructed and occupied……………
4. The project proponent has provided common STP to treat the waste water generated form the all projects. The STP was not in operation during visit due to less effluent at inlet and waste water is being collected in collection tank. There is no effluent at the outlet, therefore effluent sample could not be collected……………………………………………
5. The PP has made provision to discharge the treated water partially onto land in green area/along boundary wall for plantation and remaining in MC sewer…………………………….
6. The Project Proponent has submitted copy of letter issued by Sub Divisional Engineer, Punjab Water Supply and Sewerage, Sub Division, Barnala vide letter no. 80 dated 09.02.2021 to Sh. 7. The PP has installed water meter at the outlet of STP and energy meter. The PP is maintaining the record of STP operation w.r.t water meter and energy meter. The record was found in order. The average discharge of the industry is about 61 KLD………………….
8. As per Building Rules of Department of Housing and Urban Development, Punjab and circulated by Board vide letter no. 24741-43 dated 30.09.2024, the detail of waste water generation of all 04 projects considering 15 residents in 01 house is as under: …………………………..

Keeping in view of above, it is recommended as under:………………………………
A. Directions u/s 33-A of Water Act, 1974 issued against the project may be dropped off……………………..
B. Consent to operate under Water Act, 1974 may be granted to the Project Proponent for residential project for a period upto 30.09.2026 with suitable conditions along with specific conditions as under:………………………….
1. The project proponent shall be bound to comply with EIA notification dated 14.09.2006………………..
2. The project proponent shall utilize maximum treated effluent inside its premises after treatment in STP………………..
3. The PP shall made provision to utilize its treated domestic in dual plumbing for flushing purpose…………………
4. The Project Proponent shall obtain other statutory approvals required from other departments, if any……………..
5. The project proponent will handle its solid waste as per the provisions of the Solid Waste Management Rules, 2016 and make adequate arrangements for treatment of wet waste and source of generation……………….
