File Note: It is intimated that the show cause notice for refusal of Consent to operate for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry vide this office letter no. 1443 dated 09.04.2025 with an opportunity to submit reply within 15 days. The project proponent has submitted the reply vide dated 15.04.2025, which is reproduced as under: Sr. No. Observations Reply submitted by Industry 1. The industry has installed RMC plant of capacity 45m3/hr in its premises. The conveyor belt system and dust collector is not yet installed and the same was found arrived at site. It is submitted that industry has installed all the machinery as per NOC for installation of RMC plant, the conveyor belt system and dust collector has been installed photographs uploaded 2. The industry has also constructed one no. tank for storage of fresh water to be used in manufacturing of RMC. The industry has constructed one no. tank of size 20x20x14 for storage of fresh water for use in manufacturing of RMC. It is also submitted that industry will reuse waste water for the RMC plant in the same process. Photographs are uploaded alongwith. 3. The industry has constructed one no. weighing machine, office, labour quarter, kitchen. The project proponent has provided underground tanks for wastewater generated from labour quarter and bathrooms having no outlet. The industry has provided 3 no. rows of eucalyptus all around the unit and towards the marriage palace. The representative informed that the other side of wall is being used for storage of raw material. Also DG set to be installed on the corner of said wall. Other construction of walls has also started adjacent to DG set area. The industry will store the raw material away from buffer zone. The DG set yet to be installed on the corner of the industry premises The DG set with canopy with adequate height will be installed after getting the consent to operate and covered with sheets away from the buffer zone. To verify the facts, the site was visited by the officer of the Board on 21.04.2025 and during visit it was observed as under: 1. The industry has installed RMC Plant having two silos, Mixture, conveyor having capacity of 45 m3/h. 2. The industry has not paved the movement area. No raw material has been arrived at site. 3. The industry provided fresh saplings of conocarpus trees of 2 rows in L shape towards hotel site in an area of about 10 feet from the boundary of the hotel site. Copy of the visit report is attached herewith The industry was advised to plant more trees to provide proper buffer zone towards hotel site, so that it will not cause any nuisance to complainant. In view of the above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for short period of 6 months i.e 30.09.2025 with suitable and additional conditions: 1. The industry shall carry out more plantations along its boundary walls, if it causes any nuisance to the nearby area/hotel. 2. It is responsibility of project proponent that it will not cause any nuisance/ dust emission to nearby area/ hotel, otherwise the Board has right to revoke/ cancel the consents of the RMC. 3. The industry shall not generate and discharge any kind of trade effluent from its process. The industry shall discharge only domestic effluent onto land for plantation within premises, after passing through septic tank. 4. The industry shall immediately provide flow meter at the tubewell installed in its premises. 5. The industry shall keep the movement area clean and in good conditions, at all times. 6. The industry shall provide mechanical water sprinklers all along the boundary walls of the unit, so as to mitigate the dust pollution. 7. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water. 8. The industry shall comply with the zoning guidelines of PUDA/GMADA/Department of Town & Country Planning, at all times. 9. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 10. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 11. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 12. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 13. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 14. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 15. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency - Environmental Engineer
