File Note: It is submitted that the industry is small scale red category unit and earlier the industry was visited by the officer of this office and it was observed that the industry could not produce any MOU made with CETP Operator and operate its unit without consents of the Board. Thereafter the industry was issued directions u/s 33-A of the Water Act, 1974 for disconnection of the electric supply vide letter no. 6184 dated 22.10.2024 alongwith sealing of polluting machinery/D.G. set. Further, the electric connection of the industry was disconnected by the PSPCL authorities vide TDCO no. 83/271 dated 13.11.2024 and polluting machinery of the industry has been sealed by the officer of this office on 13.11.2024. Thereafter the industry has applied for fresh consent to operate under the Water Act, 1974, which was granted to the industry upto 09.06.2025 alongwith temporarily restoration of electric connection for six months. Thereafter the industry has applied for fresh consent to operate under the Water Act, 1974, which was granted to the industry upto 12.12.2025 alongwith temporarily restoration of electric connection for six months. Now, the industry has applied for Consent to Operate under the Water Act, 1974 through OCMMS. The industry has deposited CTO fee of amounting to Rs. 5500/- vide R.no. 600355831 dated 21.11.2025 under the Water Act, 1974, which is adequate upto 31.03.2031. The industry was visited by the officer of this office on 12.12.2025 and it was observed as under: - 1. The industry was in operation during the visit and was engaged in electroplating and pickling process using HCL. 2. The industry has provided 9-barrel machines (out of which 1 standby) and 1 drum for washing. 3. The industry has provided 1 PVC storage tank capacity of 2000 ltr and approx. 1500 ltr. was lying stored. 4. The industry has made an agreement with M/s JBR Technologies Pvt. Ltd CETP, Focal Point, Ludhiana @ 4000 ltr/month for lifting of trade effluent. 5. The industry has provided 1 no. water meter and the reading of the water meter was observed as 83.95 KL during the visit. 6. The washroom facility has been provided by the industry near the work area, however, the same was found temporarily closed during visit. During checking of the domestic sewer at the rear side of the premises revealed strong pH, which indicates the possibility of discharge of trade effluent into the sewer through the washroom outlet. As per above, the industry is not complying with the provision of the Water Act, 1974. ……………Further, the industry is required to adopt general SOPs devised foe the electroplating/surface cleaning industries as under:……… 1. The industry shall increase the capacity of effluent collection tank, atleast equivalent to the CETP agreement, by providing additional storage tank........... 2. The industry shall prepare a revised lifting schedule with the CETP operator and to ensure that the lifting shall be made atleast 3-4 times in a month and take a written assurance from the operator. ........... 3. The industry shall install CCTV cameras with 30 days backup, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks d) any other suitable point deemed fit to ensure that whole of the water consumed is metered and whole of the trade effluent is lifted to CETP operator The industry shall maintain in-house monitoring mechanism through mobile phone/ office screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed. ............. 4. The industry shall ensure that there is no unauthorized mode of wastewater disposal. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. .......... 5. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. .............. 6. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law.............. In view of the above, it is recommended that SCN for refusal of CTO under the Water Act, 1974 may be issued to the industry with opportunity of personal hearing before SEE, ZO (Competent Authority).
