It is submitted that the industry is small scale red category unit and is engaged in electroplating process. B. Earlier the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/LDH4/2023/21175445 dated 28.07.2023, which is valid upto 30.06.2026 with suitable and special conditions mentioned therein. C. Earlier, while inspected illegal discharge done by the industries in MC sewer in Focal Point, Phase-7 area on 16.04.2025 during late night alongwith MCL officials, A flexible pipe carrying acidic effluent was found discharging effluent into MCL sewer. Accordingly, the industry was visited by the officers and found that the electroplating process was not in operation. The collection tank provided by the industry was about 50% full of its capacity. The industry had provided a pump with flexible pipe in the collection tank which lead to a haudi located outside the industry, which further leads to MCL sewer. Thus, the industry was discharging untreated effluent from collection tank into MCL sewer. The industry has provided water meter at source of fresh supply of water in process area and reading of the same was 46.50 KL. No record was produced by the industry. As such, the industry is violating the provisions of Water Act, 1974. D. Accordingly, the Competent Authority of the Board was issued directions u/s 33-A of the Water Act, 1974 vide Board’s letter no. 3136-38 dated 07.05.2025 for disconnection of electric supply alongwith sealing of water polluting machinery installed by the industry. E. In compliance of the directions, the PSPCL authority was disconnect the electric supply of the industry vide TDCO no. 1820 dated 25.06.2025 and water polluting machinery of the industry was sealed by the officer of this office……………………………..
1. F. Now, the industry has applied for consent to operate under the Water Act, 1974 through OCMMS. G. The industry was visited by the officer of this office on 09.12.2025 and it was observed as under: - 1. The industry was not in operation due to disconnection of electric supply. 2. The water polluting machinery was sealed and seal was found intact during the visit. 3. The industry has provided water meter in the process area. 4. The industry has permanently removed bypass arrangement. No bypass or unauthorized mode of disposal was observed during the visit. 5. Only domestic effluent is being discharged into the sewer. 6. The industry was advised to maintain the record whenever the industry was in operation. 7. The industry has installed CCTV cameras facing towards entry gate of processing shed, flow meter provided on freshwater supply provided for processing activities, effluent storage tanks and overall view of process and industry with 30 days backup. 8. No boiler/furnace/D.G. set has been installed by the industry. 9. The industry has submitted land use classification certificate from District Town Planner, Ludhiana vide 252 dated 01.02.2023 mentioning that the site falls under industrial Zone as per approved Master Plan of Ludhiana. 10. The industry has submitted approved building plan approved by the Competent Person. The industry is now complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974...............
In these type of cases the Board has been imposing Environmental Compensation amounting to Rs. 01 lakh on the industry before granting consents to operate................ In view of above, it is recommended that the industry shall be directed to deposit EC amounting to Rs.01 lakh before the following action:- 1. Electric connection of the industry may be restored and de-sealing of polluting machinery may be carried out for short term period i.e. six months. 2. Consent to Operate under the Water Act, 1974 may be granted to the industry upto six month with suitable conditions as per policy of the Board and with special condition as under: - 1 The industry shall prepare a revised lifting schedule with the CETP operator and to ensure that the lifting shall be made atleast 2-3 times in a month and take a written assurance from the operator. .............
2. The industry shall ensure that there is no unauthorized mode of wastewater disposal. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. .........
3. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. ........
4. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law..........
