Previous history
It is submitted that the restaurant/Dhaba is a 250 chair Dhaba, operating its unit without obtaining consent to operate as required under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as failed to comply with the decisions of personal hearing given to it earlier. The Restaurant had also failed to achieve the prescribed standards for discharge of effluent onto land for plantation. Thus, violating the provisions of said Acts and causing pollution.
Accordingly, show cause notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 was issued to the restaurant/Dhaba with an opportunity of personal hearing before the Chief Environmental Engineer(B) of the Board on 09/05/2025.
After hearing the Proprietor of the restaurant/Dhaba and officer of the Board, the Chief Environmental Engineer (B) decided that :
1. The Environmental Engineer, Regional Office, Fatehgarh Sahib shall encash the 50 % of bank guarantee amounting to Rs. 2.0 lakh, submitted by it, immediately.
2. The restaurant shall apply for consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 7 days.
3. The restaurant shall operate & maintain the STP regularly and efficiently, so as to achieve the prescribed standards at all the time.
4. Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the restaurant, verify the contentions, to collect the treated effluent sample, process the consent applications to be submitted by it on merits immediately after 7 days and submit the report accordingly.
Now, in compliance to personal hearing decision no. 2. the Restaurant/ Dhaba has applied to obtain varied Consent to Operate under the provision of the Air (Prevention and Control of Pollution) Act, 1981 for a chair capacity of 400 chairs per day having 250 no. chairs in the Dhaba and 150 chairs in the Banquet Hall in the name of M/s Punjabi Rasoi Village Badali Ala Singh, Sirhind Chandigarh Road, District Fatehgarh Sahib with adequate fees and documents.
Air Fee:
The restaurant/Dhaba has deposited Rs. 69300/- vide online receipt no. 336260003 dated 05.05.2025 and Rs. 21700/- vide online receipt no. 418071769 dated 11.12.2025 of under the Air (Prevention and Control of Pollution) Act, 1981. The consent fee deposited by the industry is adequate up to 31.12.2026 against the investment of Rs. 81.43 lakh as on 31.03.2025 as per CA certificate submitted by it after deducting 800% late fee charges. The restaurant/Dhaba has also deposited Rs. 4200/- vide online receipt no. 678599711 dated 05.05.2025 as NOC regularization fee, which is adequate.
Feasibility Report:
The restaurant / Dhaba has submitted a detailed feasibility report for management of pollution prepared by Metro Environ Engineers, Mohali. Accordingly, the restaurant has installed an ETP of 30 KLD for treatment of waste water which will pass through oil and grease trap initially from the kitchen. The treated waste water from the outlet of the ETP will be discharged onto land for plantation. The project proponent has also submitted the completion certificate of the ETP installed dated 15.02.2025 alongwith schematic plan.
Solid Waste:
The restaurant/ Dhaba will generate approximately 90 kg/day waste. The waste food is used in piggery farms for animal feed and the project proponent has made a valid agreement for the same. Further, for wastes like card board, paper the project propoenet will be selling the same to scrap dealers.
Rent deed:
The project proponent has submitted a copy of rent deed agreement formulated between Sh. Kalwant Singh and Sh. Lakhwinder Singh stating that the land situated at Khewat Khatauni No. 421/492, Khasra no. 6//9/2/2(0-19), 6//12(8-0) having land area of 8 kanal 19 marla out of which 4 kanal 91/2 marlas are being rented in name of M/s Punjabi Rasoi, Village Badali Ala Singh, Sirhind Chandigarh Road, District Fatehgarh Sahib dated 15.11.2023 which is valid upto 15.11.2043.
Leese deed:
The project proponent has submitted a copy of Leese deed agreement between Sh. Lakhvir Singh S/o Sh. Ajaib Singh and Sh. Lakhwinder Singh S/o Amrik Singh for a land area of 4 kanal 3 marla having Khewat no. 138/163, Khasra no. 6//23/2)4-3 for disposing treated waste water from the ETP for Irrigation of the plantation developed by M/s Punjabi Rasoi Village Badali Ala Singh, Sirhind Chandigarh Road, District Fatehgarh Sahib.
Visit:
In compliance to the hearing decision no. 4, the Restaurant was visited by the officer of Regional Office, Fatehgarh Sahib on 21.11.2025 and Sh. Lakhwinder Singh, Owner was contacted. During visit, it was observed as under:
1. The Restaurant was in operation and the Restaurant has provided 01 no. borewell for ground water abstraction.
2. The Restaurant has installed STP of capacity 30 KLD for the treatment of domestic wastewater. Which was found operational at the time of the visit.
3. During visit, the samples were taken from the outlet and aeration tank of the STP and the analysis report is produced as under.
4. The Restaurant has developed the plantation area for the disposal of the treated wastewater from the STP. The treated wastewater from the STP is being discharged onto the adjacent land for plantation.
5. The Restaurant has constructed the compost pits for the treatment and stabilization of wet waste.
6. The organic solid waste from kitchen is being lifted by piggery farms as informed by the representative. In-organic solid waste is being lifted by local plastic waste vendor as informed by the representative and the agreements for the same were produced by the project proponent.
7. The Restaurant has installed 01 no. DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height.
In compliance to personal hearing decision no. 2 the project proponent has applied to obtain Consent to operate under the provision of the Water (Prevention and Control of Pollution) Act, 1974 and under the provision of the Air (Prevention and Control of Pollution) Act, 1981 from the Board at the OCMMS portal.
In compliance to personal hearing decision no. 1 the samples were taken from the outlet and aeration tank of the STP and the analysis report is produced as under:

From above, it is clear that the result of the analysis of the effluent samples collected from the outlet of the STP and Aeration Tank are beyond the permissible limits as prescribed by the Board thus violating the provision of Water (Prevention and Control of Pollution) Act, 1974. Thus, action for the same has been recommended separately through e-Office.
Thus, the restaurant is complying with the provision of the Air (Prevention and Control of Pollution) Act, 1981.
Keeping in view of the above, it is recommended that fresh Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 for 400 chairs of Restaurant/Dhaba having a discharge of domestic effluent @ 24.2 KLD onto Land for Plantation/ Irrigation after Treatment in STP under orange category may be granted upto 31.12.2026, subject to the suitable conditions along with following special condition that:
1. The restaurant/Dhaba shall obtain varied Consent to operate under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 from the Board with requisite fees and documents.
2. The project proponent shall comply with the provisions of SWM Rules, 2016 in true letter and spirit.
3. The project proponent shall not discharge its untreated waste water in an unauthorized manner.
4. The restaurant/Dhaba shall inform the Board in writing as and when any change is occurred in the lease Deed / Proprietorship , especially with regard to the name and address of the Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Rent Deed / Leese Deed/ Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
