It is submitted that earlier the consent to operate Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 was granted to the Brick Kiln vide online reference no. CTOW/Renewal/GRP/2021/16283870 & CTOA/Renewal/GRP/2021/16283859 dated 11/10/2021, which were valid upto 30/09/2025 under orange category. Now, the BKO has applied for obtaining Fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 due to change of the ownership from Partnership to Proprietorship firm under orange category.
The industry has deposited Rs. 15880/- Vide UTR No. 986189811 dated 23/12/2025 & Rs. 16880/- Vide UTR No. 50678878 dated 23/12/2025 as consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including penalty & NOC regularization fee, which is adequate upto 30/09/2030 & Rs. 500/- as Form downloading fee against total gross value of fixed assets worth Rs. 27,80,678/- as on 30/11/2025.
The industry has submitted Dissolution deed along with application and intimated that the Smt. Madhu Bala (Continue Partner), Smt. Satwant Singh (Retiring Partner) now they have applied for obtaining fresh consents to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under new Proprietor name Smt. Madhu Bala. The BKO has submitted copy of GST certificate and also submitted copy of self-declaration of Proprietorship of the BKO as a documentary proof.
The BKO has also submitted completion certificate issued by PSCST, Chandigarh vide letter no. PSCST/CC/1100 dated 06/03/2020 intimating that the industry has constructed induced draft Brick Kiln with zig-zag firing as per the technology evolved by the Punjab State Council for Science & Technology. The Kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report (SPL-1417). The Brick Kiln has also submitted the copy of dimensional drawing/plan of Kiln showing the length of Central Island of brick kiln is less than 216 ft.
In view of the above, may if approved “Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln under new owner name for a period upto 30/09/2030 without visiting the unit/site in the light of Head Office Order No. 59 dated 02/02/2016 with suitable conditions along with the special condition that:-
1. The project proponent shall comply with code of practice/directions issued by PSCST, Chandigarh.
2. The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016.
3. The brick kiln shall get its stack emission analyzed as per policy of the Board.
4. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
5. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
6. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
7. The Brick Kiln shall use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s notifications no. 10/574/2022-STE1/443 dated 04/11/2022. |
