File Note: It is submitted that earlier, the HCF was granted authorization under the Bio-Medical Waste Management Rules, 2016 vide no. BMW/Renewal/SGR/2023/24137455 dated 15.12.2023 valid upto 30.06.2024 for the operations of hospital having bed capacity 25 beds. Further, the HCF has auto renewed its authorization under the BMW Rules, 2016 vide no. BMW/Renewal/SGR/2024/26083645 dated 30.06.2024 valid upto 30.06.2027 for 25 beds capacity. Now, the HCF has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 along with requisite documents for 25 beds capacity. The HCF has deposited consent fee of Rs. 15,000/- vide no. 414254288 dated 05.12.2025 under the Water Act, 1974 and Rs. 15,000/- vide no. 533673672 dated 05.12.2025 under the Air Act, 1981, against the bed capacity of 25 beds. As per Board's notification no. EPA/2017/No.2235-59 dated 07.07.2017, the consent fee for hospitals is applicable w.r.f 01.04.2016. Hence, the consent fee is adequate upto 31.03.2031 under the both acts. The HCF has submitted electricity bill as the proof of date of commissioning, as per which the connection date is 09.05.2013 and same is considered as date of commissioning. The brief details of the case applied by the healthcare facility is as under:- 1. The HCF has submitted agreement made with M/s Medicare Environments Management Pvt Ltd. located at Ludhiana issued for capacity of 25 beds vide dated 01.07.2022, which is valid upto 30.06.2027. 2. The HCF has submitted copy of manifests of lifting of waste by CBWTF operators. 3. The HCF has also submitted Self Declaration form as per Annexure-I. 4. The HCF has submitted the copy of site plan approved by EO, MC, Sunam. 5. The HCF has submitted copy of registry of land. Accordingly, the HCF was visited by the officer of the Board on 24.12.2025 and it was observed as under:- 1. The HCF was found in operation during visit and is 25 bedded hospital. 2. The HCF is segregating Bio-Medical Waste as per the Bio-Medical Waste Management Rules, 2016. 3. The HCF has provided color coded bins and bags in its premises to collect & segregate the bio-medical waste. Bar code stickers were being used for color coded bags. 4. A storage room with lock & key arrangement has been provided for the storage of bio medical waste, to be lifted by CBWTF. 5. The HCF is maintaining the records related to the generation, collection, storage, and lifting of the bio-medical waste. 6. The liquid waste generated by the HCF is being treated with sodium hypo chloride solution. 7. The hospital has 01 no. D.G set of capacity 40 KVA equipped with canopy and stack of adequate height. As per the latest Office Order of the Board vide no. 379 dated 23/10/2023, “it has been decided that HCFs upto 30 beds capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal STPs have been installed shall be granted consents to operate and Authorization without installing individual ETPs as an interim arrangement, subject to the condition that HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time. In the present case, the HCF is located in City Sunam, where the terminal STP has already been installed and the same is in operation. Moreover, as per the office order no. EPA/2017/No. 5261-86 dated 15/12/2017 the competency of upto 50 beds HCEs and Labs and Blood Banks, Pathological Lab, Veterinary Institutions/Animal House etc. lies with the Environmental Engineer of the Regional Office's. In light of above office orders, the HCF is found complying with the provisions of the Water Act, 1974 and the Air Act, 1981. As per record of this office, no action is pending against the health care facility for violation of the Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986. Keeping in view of above, if approved, the HCF may be granted fresh consents to operate upto 31.03.2031 under the Water Act, 1974 and the Air Act, 1981 with suitable conditions and with special conditions that: 1. This consent is valid for 25 Beds only. HCF will apply for CTO/CTE if it increases its bed capacity. 2. The HCF will comply with the provisions of the BMW Rules, 2016, the Water Act, 1974 and the Air Act, 1981 in true letter & spirit. 3. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same. 4. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year. 5. The HCF will maintain proper record of generation and lifting of bio-medical waste. 6. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis. 7. The HCF shall obtain other statutory approvals required from other departments, if any. 8. The HCF shall achieve the prescribed effluent discharge standards. Competency Environmental Engineer
