It is submitted that brick kiln is a Small Scale / Orange Category existing unit. It has already been obtained the Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOA/Renewal/LDH2/2021/13316211 dated 05/03/2021 valid upto 30/09/2027 for manufacturing of Bricks & Tiles @ 30000 Numbers/Day.
Now, the brick Kiln has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of of Bricks & Tiles @ 30000 Numbers/Day using Clay and Sand @ 90 MTD alongwith required documents & Fee as under: -
1. The Brick Kiln is an existing unit Since June, 2002.
2. The Brick Kiln has submitted the copy of Location Plan, feasibility report.
3. The kiln has provided an induced draft technology with Zig-Zag firing.
4. The brick kiln has submitted completion certificate vide no. 718 dated 07.11.2019 issued by Punjab State Council for Science & Technology.
5. The industry has submitted the DTP certificate vide no. 2732 dated 13.09.2013.
6. The value of Fixed assets of the Brick Kiln is Rs. 26.88 Lacs as on 18.11.2025.
7. The Brick Kiln has deposited Rs. 41000/- vide R.No.541332754 dated 19.11.2025 (Rs. 14500/- Water Consent Fee + Rs. 1000/- NOC regularization + Rs. 25500/- Penalty of fee) and Rs. 17500 /- vide R.No. 122325658 dated 08.12.2025, which is adequate upto 30.09.2030 after deducting penalty of 700%.
To verify the facts, the site of the Brick Kiln was visited by the undersigned on 22.12.2025. During visit it was observed as under: -
1. The Brick Kiln was in operation.
2. It has provided Porthole and platform with stair to collect the sample of stack emissions.
3. There is only generation of domestic effluent and same is discharged onto land for plantation after septic tank.
4. Approach roads and periphery road were stablished by using keri.
5. The BKO has provided plantation along the boundary.
6. The BKO has provided the display board in compliance to Hon’ble National Green Tribunal (NGT) order dated 25.02.2025 in OA no. 359/2022 in the matter of Rafhat Naeem Siddiqui Vs state of UP & Ors.
7. The Brick Kiln is complying with the Code of Practice Prescribed for Brick Kilns.
Keeping in view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to Brick Kiln upto upto 30.09.2030 with usual conditions and special conditions that: -
1. The BKO will comply with all the code of practice prescribed by the Board for Brick kilns all times.
2. The BKO shall use small spoon for feeding of fuel.
3. The BKO shall use only crushed coal and paddy straw pellets as per notification issued by the Govt. as
4. fuel in the brick kiln.
5. The BKO shall not emit black smoke at any point of time.
6. The BKO shall not use unauthorized fuel at any point of time.
7. The BKO shall comply with all the directions issued by the MoEF/CPCB/Govt./PPCB from time to time.
