It is intimated that earlier, the industry has applied consent to establish (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. The case was scrutinizing and sent to Zonal Office, Amritsar for grant of NOC. Therefore, the case was scrutinizing and observed that the industry has proposed to discharge treated trade effluent into PSIEC sewer, however has not submitted any permission from PSIEC regarding discharge of treated trade effluent into their sewer. Accordingly, show cause notice for refusal of Consent to Establish (CTE/NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued vide letter no. 4292 dated 03/12/2025 in writing, within 5-days from the issuance of this show cause Notice. Accordingly, the industry has submitted that as informed by the PSIEC, the NOC regarding sewer connection shall be given after starting of construction work at the site. The reply of the industry is not satisfactory and the application for NOC be refused.
Now, the project proponent has applied for obtaining consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for setting up of an orange category industry.
The industry has submitted an undertaking that the sewer connection/NOC as discussed with the PSIEC Department we were informed that as per their policy, the sewer connection/NOC is issued six months after the commencement of construction. At the time of applying for consent to operate, we shall attached and submit the required sewer NOC issued by PSIEC. Further, the representative of PSIEC was also contacted and he informed that the sewer connection shall be given to the industry after construction work started.
The industry has also deposited Rs. 6100/- vide UTR No. 269058706 dated 23/10/2025 consent to operate under Air (Prevention & Control of Pollution) Act, 1981, which is adequate for one year period including Rs. 500/- as form downloading fee against the fixed assets of Rs. 99.21 Lacs.
The industry has submitted requisite documents along with the application which can be pursued. The industry has proposed to install ETP of capacity 2 KLD consisting Screen Chamber - Collection Tank -Coagulation Tank -Flocculation Tank -Primary Tube Settler -Filter Feed tank - Pressure sand Filter -Activated Carbon filter - Sludge Drying Beds to treat effluent generated from washing of mixing containers i.e. 2 KLD, which shall further discharge into PSIEC Sewer after treatment. The industry has proposed to provide to discharge domestic effluent @ 1 KLD into PSIEC Sewer. The industry was visited by officer of this office on 07/11/2025 and observed as under:-
1. The industry is situated at Industrial Growth Centre of Pathankot.
2. The industry has not yet started the construction work at the site, only a plot was available at the site.
3. The industry has proposed to install one no. D.G. sets of capacity 10 KVA, which shall be equipped with canopy.
4. The industry has submitted a its proposed manufacturing process as per which, the industry shall only engage in mixing of raw material, no processing of any chemical is proposed by the industry.
5. The industry has proposed to purchase chemical used as raw material directly from the market.
6. The industry has submitted transfer letter of Plot No. F-49(P) Industrial Focal Point, Pathankot measuring 850 Sq.yds in your favour on 99 years Lease hold basis for the setting up an industrial unit from PSIEC vide no. No. PSIEC/ESTATE/EO 10298-10302 dated 13/08/2025 on the name of Sh. Puneet Mahajan, Partner of the industry.
The project falls in Orange category in small scale sector, hence competency to decide the case lies with the Senior Environmental Engineer of the Board (Agenda Note is also attached herewith).
In view of above, it is recommended that consent to establish (NOC) from pollution angle may be granted for one year period with suitable conditions along with special condition :-
1. The industry shall comply with the conditions of allotment/transfer letter issued by the PSIEC.
2. The industry shall not manufacture any chemical in its premises, which comes under the preview of EIA Notification, 2006.
3. The industry shall obtain Approved Building Plan from the concerned department.
4. The industry shall apply for consent to operate of the Board as required under the provision of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981.
5. The industry shall obtain permission regarding sewer connection from PSIEC.
