As discussed with your goodself, in absence of alternate disposal arrangement the project proponent has proposed to dispose 1.75 KLD for sprinkling of dust suppression till it will get sewer connection, which seems adequate in principle.
As such, in view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, may be granted to the project proponent for one year with usual conditions & with following special conditions:
1. This NOC is valid for establishment of a new establishment of Commercial Plots @ 6 no.
2. The project proponent shall make agreement with the local authorities for permission regarding sprinkling of treated wastewater onto roads and submit the copy of the same in this office in 15 days.
3. The project proponent shall install the storage tank of adequate capacity for storage of treated wastewater for 15 days in case, the water is not being utilized in sprinkling purposes during rains.
4. The project proponent shall install the water meter at the outlet of the storage tank and shall maintain the record of the water consumed for sprinkling purposes from that meter.
5. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water.
6. The project proponent shall not allow any occupancy at its project, without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
7. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss (including financial) to the project proponent in this regard, howsoever.
8. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
9. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
10. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area.
11. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
12. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated in-house, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
13. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
14. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
15. The adequacy/ efficacy of the pollution control arrangements and disposal arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
16. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
17. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
18. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
