Discussed with CEE (B) in presence of SEE (ZO-2, PTA), it emerged as under:
1. Presently, the site of the industry falls in residential zone of Master Plan Khanna.
2. As per section 79 of PRTPD Act, 1995, any activity not conforming with Master Plan, cannot be allowed to be carried out in non-designated zone beyond the limit of 15 years if not extended by the Govt. In case of Khanna, the same has not been extended by the Govt.
3. The Master Plan of Khanna was notified on 03.1.2011 which will remain in force upto 03.10.2031. However, the activity not confirming to Master Plan can be allowed to operate at existing site only for fifteen years i.e. upto 02.01.2026.
4. As per Boards policy, no new industry of any category shall be allowed in the approved residential area of any town/city of the State of Punjab and no red/orange category of industry shall be given consent to establish within M.C. limits except in the designated industrial area/zone. Further, the PPCB will continue to grant consent to establish to any category of industries, which are permissible in the mixed land use areas/zones as per by-laws of the notified Master Plan / draft master plan.
In present case, neither the site of the industry falls within mixed land use zone nor in designated industrial zone within MC limits as the spot zoning or adjustment of the unit on the basis of report of MC Khanna has not been done by DTP, Ludhiana.
5. Further, the industry has proposed to install the new boiler of capacity 3000 Kg/hr to be run on PNG by replacing existing boiler of 500 kg/h running on wood pellets which means the steam requirement capacity has been enhanced almost 6 times. Thus, there must be change in pollution load with change in product mix though no change has been proposed to be done in raw material. Moreover, the industry has not submitted mass balance and simply mentioned that there will not be any increase in pollution load....
In light of the above, if approved, the CTE (modernization cum expansion) applied by the industry for installation of new boiler on PNG and to change the product may be refused due to the reasons mentioned above, pl.
