The agenda note has been perused and it has been noted down that the site of the industry falls in residential zone. As the Master Plan of Khanna has been notified on 03.01.2011 and thus, the industry can be allowed to run for fifteen years as per section 79 of PRTPD Act,1995 in non-confirming zone which is going to expire on 02.01.2026. Moreover, the DTP, Ludhiana is yet to adjust the unit by spot zoning it as industrial zone in light of the report given by MC, Khanna. In these circumstances, the industry cannot be allowed to run beyond the said date as the Govt. has not extended the said timeline in case of Khanna as was done in case of Ludhiana
Hence, if approved, notice to issue directions u/s 31-A of the Air Act,1981 as amended in 1987 and u/s 33-A of the Water (Prevention & Control of Pollution) Act,1974 proposing following directions alongwith an opportunity of personal hearing before the CEE (B) of the Board may be issued, pl:
1. That the industry shall take all necessary steps to close down its operations and stop forthwith discharging any emissions into the atmosphere and effluents/ wastewater onto land for stagnation/ inland surface water/ irrigation or through any mode.
2. That the industry shall immediately stop its operation / activities and will not restart the same unless the site of the industry is adjusted as industrial zone in the Master Plan, Khanna by the Department of Town & Country Planning, Govt of Punjab.
3. That the industry shall not restart discharging its effluent/ air pollutants until it obtains the consent of the Board to operate an outlet/ plant u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 after the action at Sr, no.3 is completed.
4. That the Punjab State Power Corporation Ltd. shall be directed to disconnect the supply of electricity available to the industry with immediate effect and shall be further directed to allow 2% of the contract demand or 100 KW (whichever is less) of electric power available with the industry for its office use only.
5. That the Board shall also issue any directions as deemed fit to the industry and its responsible persons for violating the provisions of the Pollution Control Laws.
