Sub: Proceedings of the personal hearing given before Senior Environmental Engineer, Ludhiana on 22.12.2025 w.r.t. Show cause notice for refusal of consent to establish under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.- M/s Shree Ganesh Industries, E-411, Phase-Vi, Focal Point, Ludhiana.

No one attended the hearing.
Environmental Engineer, Zonal Office-2, Ludhiana brought out that the industry is small scale red category unit and has applied for fresh consent to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for 1044-Industry or process involving metal surface treatment or process such as pickling/electroplating/paint stripping/heat treatment using cyanide bath/ phosphating or finishing and anodizing / enameling/ galvanizing and trade effluent @0.14 KLD lifted by CETP Operator (JBR) and domestic effluent @0.8 KLD into MC sewer.
The industry was visited by the officer of the Board on 17.11.2025 and it was observed as under: -
1. The industry was in operation during the visit.
2. The industry is engaged in zinc plating process and has installed forging hammers with billet heaters. The industry has also installed 02 shot blast machines with inbuilt bag house filter as APCD with adequate stack height and other allied machineries.
3. The industry has made an agreement with M/s JBR Technologies Pvt. Ltd., D260-261, Phase8, Focal Point, Ludhiana for lifting of trade effluent @ 3500 Itr/month dated 02.09.2024.
4. The industry has provided water meter at the source of fresh water supply and the reading noted was 61.02 KL. The industry has provided PVC collection tank which was approximately 45% full during the visit.
5. The industry has not submitted the record of total water consumption viz-a-viz effluent lifted.
6. The industry has installed 02 no. D.G. set of unknown capacity and without acoustic enclosure.
The industry is not complying with the provisions of the Water Act, 1974 and Air Act, 1981.
The matter was considered by the Competent Authority and it was decided to initiate action against the industry for refusal of consent to establish under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause notice.
Show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry, to reply within 07 days, vide Board’s letter no. 6714 dated 26.11.2025.
The industry has submitted a written reply to the SCN issued. As per the record, the industry has consumed total fresh water @20.12 KL and lifted out 21 kl during the period from 01.06.2025 to 02.12.2025. The opening balance, as per record was 4.010 KL. The industry has provided a storage tank of 5 KL capacity and approximately, 2KL was lying stored in the tank. The industry has provided 2 DG set without an acoustic enclosure. The industry claims that the DG sets are not being used.
The industry has not installed CCTV cameras facing flow meter provided on freshwater supply provided for processing activities, effluent storage tanks and has not provided the designated place for the record register. The industry has provided 2 DG set without an acoustic enclosure.
The industry is not complying with the provisions of the Water Act, 1974 and Air Act, 1981.
The matter has been considered by the Competent Authority and it has been decided to initiate action against the industry for refusal of consent to establish under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing……………
Accordingly,show cause notice for refusal of consent to establish under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Ludhiana on 22.12.2025……………
No one on behalf of the industry attended the hearing……………
Environment Engineer, Zonal Office-2, Ludhiana brought out that the consent applications of the industry are lying pending since long. Further the industry is required to comply with standard operating procedure for the electroplating units/surface cleaning units/pickling units and thereafter the application shall be consider for grant of consents to operate…………….
After hearing, the officer of the Board, the Senior Environmental Engineer of the Board decided that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 applied by the industry be refused…………….
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
