The report/ recommendations sent by RO has been examined and it is brought out as under:
# The industry was earlier granted Consent to Operate under the Water and Air Acts up to 30.06.2023 for manufacturing LDPE granules @ 1050 kg/day.
# During inspection on 30.06.2023, violations were observed including installation of additional machinery without prior approval and suspected manufacture/storage of plastic carry bags, which are prohibited in Punjab.
# Accordingly, the Board refused renewal of CTO, imposed Environmental Compensation of Rs. 2.00 lakh on the unit, and ordered disconnection of electricity supply, vide directions dated 18.07.2023.
# Thereafter, the unit had filed appeal against the Board order and direction
dated 18.07.2023 before the Appellate Authority. The case was heard by the Appellate
Authority on 05.09.2023 and upheld the order and directions dated 18.07.2023 of the Board.
# The project proponent had laterdeposited Environmental compensation amounting to Rs. 2 lakh vide R no. 32/5590 dated 17.09.2024.
# During inspection of the area, the condition of the industry was found to be operational as seen from outside and the PSPCL authority was again requested vide no. 4305 dated 27.10.2025 to disconnect the electricity connection of the industry in reference to the previous direction issued by the Board. The RO has reported that the PSPCL authority now disconnected the electricity connection of the industry vide TDCO no. 100030419682 dated 03.11.2025.
# Now, the unit has applied for fresh Consent to Operate under the Water and Air Acts for the same approved activity of LDPE granule manufacturing @ 1050 kg/day. The project proponent has submitted request letter to restore the electricity connection.
# During the latest inspection on 17.12.2025, the unit was found non-operational due to power disconnection. The previously installed blow-moulding machines have been removed, no plastic carry-bag manufacturing activity was observed, no DG set or trade effluent exists, and the unit is located in an approved industrial area. The RO has pointed out that the unit has not obtained EPR registration under PWM Rules, 2016; however, valid CTOs are required for obtaining EPR registration under PWM Rules, 2016.
# The RO has recommended for grant of CTOs under the Water Act, 1974 & the Air Act, 1981 to the project for short term i.e. upto 30.06.2026 and issuance of amended directions to the PSCPL authorities for restoration of electricity supply to the project upto 30.06.2026.
In consideration of the report/ recommendations of RO; if approved, the competent authority be recommended as under:
i. Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for short term i.e. 30.06.2026 with suitable conditions and the following additional conditions that:
a) The project proponent shall obtain EPR registration under PWM Rules, 2016 within one month.
b) The industry shall use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021
c) The industry will carry out stack emission monitoring of wet scrubber from NABL approved lab after restoration of electricity connection and submit report to Board.
d) The industry shall not manufacture recycled/ virgin plastic carry bags in any case and shall comply with the provisions of notification no. 05/18/2016 11g4/692717/1 dated 18/02/2016 issued by the Department of Local Govt., Government of Punjab and notification no. S.O.438 /Ρ.Α.9/1994/S30/2016 dated 29/03/2016 issued by the Department of Rural Development & Panchayats, Government of Punjab in letter & spirit.
ii. PSPCL may be directed to restore the electricity connection available to industry for short period i.e. 30.06.2026.
