It is intimated that the project proponent has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a new Residential colony having 98 no. affordable housing plots, EWS Plots having 15 nos, Commercial plots @ 12 no., and Community Centre and Floating Population 323 Person in a total area of 24192 sq. mtr. i.e. (4.99 acres), alongwith requisite documents and fees.
The project proponent has deposited Rs. 21600/- vide R. no. 980654649 dated 05.12.2025 including application form fee, against the cost of the project of Rs. 14.91 Cr. (as per project report and application form). The NOC fees deposited by the project proponent is adequate for 01 year.
Suitability of Site:
The project proponent has submitted a copy of approved layout plan digital signed by Competent Authority Sh. Tejpreet Singh Wasu dated 15.07.2025. Also, the project proponent has submitted a copy of License to develop a project/colony issued by Office To The Competent Authority (Under PAPRA Act,1995)- Cum Additional Deputy Commissioner (Urban Development), SAS Nagar vide letter no. LDC/CA-ADC(UD)/2024/75 dated 28.10.2025 for developing land into Affordable Residential Plotted Colony name and style of “Miwan City” on an area of 24 Bigha 0 Biswa or (4.99 Acre) at Village Gulabgarh, Tehsil Derabassi, Distt. SAS Nagar, having validity upto 27.10.2030, which confirms the compliance of project site to zoning regulation as per Master Plan.
Water Pollution:
The project proponent has proposed to develop for establishment of a new Residential colony having 98 no. affordable housing plots, EWS Plots having 15 nos, Commercial plots @ 12 no., and Community Centre and Floating Population 323 Person in a total area of 24192 sq. mtr. i.e. (4.99 acres). The population estimation, wastewater calculation and water balance submitted by the project proponent is as under:
The project has obtained the approval from the MC Derabassi vide letter no. 4453 dated 10.12.2025 for disposal of treated wastewater onto sewer leading to the terminal STP of the town.
Air Pollution:
The project proponent has proposed to install one no. DG set of capacity 500 KVA, which is provided with canopy and adequate stack height.
Applicability of EIA notification dated 14.09.2006:
The project proponent has proposed to develop for establishment of a new Residential colony having 98 no. affordable housing plots, EWS Plots having 15 nos, Commercial plots @ 12 no., and Community Centre and Floating Population 323 Person in a total area of 24192 sq. mtr. i.e. (4.99 acres), which is less than 50 hectares, as such, the project is not covered under schedule 8 (b) of the EIA notification dated 2006.
Visit:
The site of the project was visited by undersigned on 24.12.2025 and during visit, it was observed that:
1. No building construction has yet been started at the site.
2. The project proponent has initiated the work of construction of internal roads. Pavement of roads is not initiated yet. The laying of sewer pipelines is under progress.
3. As per the site limits shown by the representative during visit there is no air polluting industry within a radius of 100 mtr. from the proposed site of the project and there is no MAH industry within a radius of 250 mtr. from the proposed site of the project. Thus, the site is suitable as per notification dated 25.07.2008 as amended on 30.10.2009.
Recommendations:
In view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, may be granted to the project proponent for one year with usual conditions & with following special conditions:
1. This NOC is valid for establishment of a for establishment of a new Residential colony having 98 no. affordable housing plots, EWS Plots having 15 nos, Commercial plots @ 12 no., and Community Centre and Floating Population 323 Person in a total area of 24192 sq. mtr. i.e. (4.99 acres).
2. The project proponent shall ensure to install an STP of capacity of 200 KLD and will dispose the treated wastewater into mentioned disposal modes only.
3. The project proponent shall reuse treated wastewater for flushing purpose by providing dual plumbing system in the project and shall use only treated wastewater for the said purpose. The project proponent shall impose a condition in this regard in all the allotment letters/registries to be done in the project.
4. The project proponent shall not carry out construction activity by its self and shall only sell plots to respective owners.
5. The project proponent shall not carry out any activity which is covered under the ambit of EIA notification dated 2006.
6. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water.
7. The project proponent shall use the treated effluent for onto land for plantation within its premises and shall use only treated wastewater for the said purpose in its project.
8. The project proponent shall not allow any occupancy at its project, without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
9. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss (including financial) to the project proponent in this regard, howsoever.
10. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
11. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
12. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area.
13. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
14. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
15. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
16. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
17. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
18. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
19. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
20. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
21. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
22. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
23. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
24. The adequacy/ efficacy of the pollution control arrangements and disposal arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
25. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
26. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
27. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
