File Note: It is intimated that the industry is small scale red category (1044-Industry or process involving metal surface treatment or process such as pickling/electroplating/paint stripping/heat treatment using cyanide bath/ phosphating or finishing and anodizing / enamellings/ galvanizing) industry. Earlier the industry was identified by office of this office on 24.02.2025 and observed as under: - 1. The industry was engaged in manufacturing of nut & Bolts and was in operation. 2. The industry had installed hot dip galvanizing furnaces without any APCD including pickling process. The industry was also engaged in electroplating (zinc plating) and zinc plating of thread rods. 3. No water meter was provided by the industry at source fresh supply of water in process area. 4. The industry had provided by-pass arrangement through which the untreated effluent generated from process is being discharged into MCL sewer. 5. The storage tank of the industry was in damaged conditions, which was full upto brim. 6. Housekeeping was very poor. 7. The industry was on rent & located inside the premises of M/s Karna International. 8. The industry had not obtained CTO under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 9. There was no generation of trade effluent, domestic effluent was being discharged into sewer. 10. The industry could not produce MOU made with CETP operator. Hence, the industry was violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Accordingly, directions u/s 33-A of the Water Act, 1974 and 31-A of the Air Act, 1981 has been issued for closure of the industry vide no. 1517 dated 12.03.2025. The PSPCL authorities were also directed to disconnect the electric supply of the industry vide Board’s letter no. 1518-21 dated 12.03.2025. Accordingly, the electric connection has been disconnected by the PSPCL authorities vide TDCO no. 135/271 dated 24.03.2025. Thereafter the industry was applied for fresh consent to operate under the Water Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, which was granted upto 08.10.2025 alongwith temporary restoration of electric supply i.e. upto 08.10.2025. Thereafter, the industry was visited by the officer of the Board on 27.08.2025 as the industry was in the list of non-lifting of trade effluent and the industry had not obtained CTO under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of the industry at the current site. The industry was not complying with the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Accordingly, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 was issued to the industry with an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 10.11.2025, wherein it was decided as under:- 1. The industry shall reassess the effluent quantities and make revised agreement with CETP operator, if required, as per the actual generation of effluent and submit the same to the Board, within 15 days. 2. The industry shall increase the capacity of effluent collection tank of both sections, within 15 days so as to ensure that no overflow shall take place from the storage tanks even in case of non-periodic lifting of trade effluent by the CETP operator due to unavoidable reason. 3. The industry shall prepare a revised lifting schedule (atleast on weekly basis) with the CETP operator and to ensure that adequate lifting shall be made in a month. 4. The industry shall install CCTV cameras with 30 days backup within 15 days, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks d) any other suitable point deemed fit to ensure that whole of the water consumed is metered and whole of the trade effluent is lifted to CETP operator The industry shall maintain in-house monitoring mechanism through mobile phone/ office screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed. 5. The industry shall ensure that there is no unauthorized mode of wastewater disposal. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. 6. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. 7. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law. 8. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, within 07 days. 9. The Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry to verify contentions of the industry, carry out audit of the waste water generation, submit compliances with respect to the decisions alongwith fresh recommendations and process consent applications on merit Now, the industry has applied varied 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for production of manufacturing of zinc plating & hot dip galvanizing of hardware goods @ 2 TPD. The industry has deposited Rs. 65300/- vide R. No. 524881258 dated 26.03.2025 out of which Rs. 59400/- as water consent fee and Rs. 5400/- as NOC regularization fee and Rs. 59400/- vide R. No. 283078893 dated 26.02.2025 as air consent fee against the gross value fixed assets of Rs. 59.13 lacs as C.A certificate, which is adequate upto 30.06.2030 after deducting NOC fee and late penalty fee. The industry was visited by the undersigned on 11.12.2025 and it was observed as under: 1. The industry was in operation and engaged in manufacturing of nut & Bolts. 2. The industry had installed hot dip galvanizing furnaces with wet scrubber as APCD. 3. The industry was also engaged in electroplating (zinc plating) and zinc plating of thread rods. 4. The industry has made an agreement with M/s JBR Technology Pvt. Ltd., Phase-8, Focal Point, Ludhiana for lifting of trade effluent @ 25000 ltr/month dated 12.11.2025. 5. The industry has provided 02 storage tanks of capacity 50000 Ltrs., which double of its agreement capacity and approx. 6000 Ltrs. lying stored. 6. The industry installed a water meter at the source of fresh water supply and reading was noted as 1081.20 KL. 7. The industry is maintaining the record of fresh water consumption viz-a-viz effluent lifted. As per the record, the meter readings were as follows: 960.63 KL on 01.04.2025 and 1081.20 KL on 11.12.2025. During the period from 01.04.2025 to 11.12.2025, the industry consumed a total of 120.57 KL of fresh water. In the same period, the industry lifted out trade effluent @ 113.5 KL, which is in consonance after assuming evaporation loss. 8. No bypass or unauthorized mode of disposal of trade effluent was observed during the visit and only domestic effluent is being discharged into sewer. 9. The industry has provided 01 D.G of capacity 50 KVA equipped with canopy. 10. The industry has no by-pass arrangement/unauthorized mode of disposal. 11. The industry has installed CCTV cameras facing towards entry gate of processing shed, flow meter provided on freshwater supply provided for processing activities, effluent storage tanks and overall view of process and industry with 30 days backup. 12. The site is located in the designated area i.e. Phase-7, Focal Point, Ludhiana. The site is suitable for such type of the industry. 13. The industry has submitted approved building plan approved by the Competent Person affiliated by the Director of Factories. As such, the industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and also complying with the hearing decision. In view of above it is recommended as under: - 1. Electric connection of the industry may be restored for further six months period. 2. Consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry upto six months with suitable conditions as per policy of the Board and special conditions that:- 1. The industry will be only disposing its trade effluent to CETP operator. 2. The industry will maintain the record of total water consumption viz-a-viz effluent lifted. 3. The industry will submit the record on monthly basis to Board. Competency to grant consent: SEE Competency to restore electric connection: Worthy Chairperson.
