As per the report of RO, the details of the case are as under: • The industry was earlier afforded an opportunity of personal hearing before the Chairman of the Board on 13.02.2024, wherein, it was decided that directions for closure of the unit were confirmed, legal prosecution be launched under the Water Act, 1974 & Air Act, 1981 and environmental compensation was imposed on the Stone Crusher… • Accordingly, EC of amount 32,43,750 /- vide EC Order No. 72 dated 23.02.2024 was imposed on the industry… • In this regard, RO has mentioned that the the industry has deposited portion of the Environmental Compensation i.e. Rs. 300,000/- Vide receipt no. 22/5326 dated 06.03.2024 Rs. 7,00,000/- by RTGS no. PUNBR52025121810695772 dated 18.12.2025 and is willing to deposit the balance amount as well i.e. Rs. 22,43,750/-… • RO has further mentioned that the industry has deposited 04 no. postdated signed cheque of the balance amount i.e. Rs. 22,43,750/-, upto the month of June 2026. • W.r.t. orders for prosecution, RO has mentioned that legal action has been launched by the Board under the Water (Prevention & Control of Pollution) Act, 1974 against the industry in the District Court. However, RO has not mentioned anything regarding complaint under the Air Act, 1981. • As per the note history of the case (as mentioned in e-noting no. 21040220), note dated 31.01.2025, the complaint under the Air Act, 1981 was to be filed before the adjudication officer by RO due to enactment of Air (Prevention and Control of Pollution) amendment rules, 2024.. Accordingly, the matter was discussed with AEE, RO and she informed that the complaint has not been filed, till date, even after lapse of many months….. • Now, the industry has applied for obtaining consent to operate under the water act, 1974 and air act 1981. RO has mentioned in its that the industry is complying with the code of practice, lay down for such units and is partially complying with the guidelines issued by CPCB in July 2023, except installation of bag-house filter house, CTTV, PTZ camera, telescopic chutes etc.… • In view of above and facts/ report/ recommendations given by EE RO Roopnagar, if approved, following actions may be taken: A. The industry may be allowed to deposit the remaining amount of 22,43,750/-, imposed as EC by the Board in 04 installments, upto 08.06.2026, for which post-dated cheques have been taken by regional office, Rupnagar. B. The industry may be granted consent to operate under the water act, 1974 and Air act 1981, for short time period of six months, subject to suitable conditions and conditions as imposed by RO Roopnagar. C. PSPCL may be directed to temporarily restore the electric connection available to the Industry for six months….. D. EE, RO, Roopnagar may be directed to immediately take up the matter regarding the complaint under the Air Act, 1981 to be filed before the adjudication officer by RO due to enactment of Air (Prevention and Control of Pollution) amendment rules, 2024 (as already mentioned in e-noting no. 21040220, note dated 31.01.2025). He may also be requested to follow up the complaint already filed by the Board against the unit, under the provisions of the Water Act, 1974 the Hon’ble court, please. *Competency: worthy Chairperson of the Board.
